記憶體存取專利訴訟 Visual Memory控告Broadcom

2015年5月8日，設立於美國德州的專利授權公司Visual Memory LLC，向美國德拉瓦州聯邦地院提起專利侵權告訴，控告半導體公司Broadcom Corporation所製造販賣之產品，包括但不限於型號為BCM7420的機上盒系統單晶片產品 (Multiformat Dual-HD Digital Video/Audio STB SoC)，侵害了Visual Memory所擁有之一件專利權利，關於可選擇對記憶體陣列進行不同存取的記憶體裝置與方法。

本案系爭專利為美國專利編號US 5,654,932，名稱為「可選擇存取類型之記憶體裝置及其使用方法(Memory devices with selectable access type and methods using the same)」，於1997年8月5日核發，發明人G. R. Mohan Rao。系爭專利之原始權利人Cirrus Logic, Inc.公司，營運總部設於美國德州，是一影音類比與數位信號處理元件供應商。系爭專利的申請日為1995年10月4日，意味著其專利權有效期間即將屆滿。

Visual Memory在訴狀中指出，Broadcom製造、販賣、使用可以在單一列位址閃控週期中對一記憶體陣列進行不同存取之系統與方法(system and methods of performing different accesses during a single RAS cycle to a memory array of rows and columns of memory cells)，包括但不限於BCM7420系統單晶片產品，侵害了系爭專利一或多項請求項。

Visual Memory在同日向本案相同法院，另提起3起專利侵權告訴，分別控告另外三家半導體公司、Freescale Semiconductor Inc.、Marvell Semiconductor Inc.(下稱Marvell)以及STMicroelectronics Inc.(下稱ST)，主張這三家公司所製造販賣的微處理器、微控制器等產品，侵害本案系爭專權利。Visual Memory在控告Marvell與ST之訴訟案件中，有多主張另一件專利US 6,026,027之權利被侵害，該專利名稱為「具備記憶體快取之快閃記憶體系統(Flash memory system having memory cache)」，於2000年2月15日核發，原始權利人Norand Corporation。

根據美國專利商標局(USPTO)之專利轉讓資料，本案系爭專利權利在2010年8月24日被轉讓給一家名為Huai Technologies, LLC之公司，而後再於同年12月7日因該公司被Intellectual Ventures II LLC (下稱IV) 所併購而被移轉至IV名下。

IV曾在2011年7月11日，向美國華盛頓州西區聯邦地院起訴(Intellectual Ventures I LLC et al v. Hynix Semiconductor Inc. et al，案號為2:11-cv-01145-RAJ)，控告包括Hynix Semiconductor, Inc.、Elpida Memory, Inc.、宏碁(Acer Inc.)、華碩(Asustek Computer Inc.)、Dell, Inc.、Hewlett-Packard Company等多家公司，侵害包括本案系爭專利在內之5件專利權利。該案在2012年10月以IV與所有被告均達成和解來收場。

本案系爭專利權利於2015年3月31日被轉讓給一家名為IQ Holdings, LLC，而後在於同年4月2日被轉讓給本案原告Visual Memory。(1150字；表3)
