NFC晶片專利戰 Marvell與NXP互控侵權

2015年1月21日,營運總部位於荷蘭、前身為皇家飛利浦電子公司(Koninklijke Philips Electronics N.V.)事業部之一的恩智浦半導體(NXP Semiconductors N.V.,其控股公司為NXP B.V.,下稱NXP),向美國加州北區聯邦地院提起專利侵權告訴,控告競爭對手、美國晶片製造商邁威爾科技(Marvell Technology Group Ltd.,其為設在百慕達的公司,美國營運子公司則為Marvell Semiconductor, Inc.,下稱Marvell),其所製造販賣、具備近距離無線通訊(near field communication,NFC)功能之NFC晶片產品、例如Avastar 88W8897等802.11ac晶片產品,直接與間接侵害NXP所擁有之四件專利權利。
 
NXP在其訴狀中主張,除Marvell製造販賣NFC晶片產品之行為構成直接侵權外,Marvell亦意圖誘使他人直接侵害NXP之系爭專利權利,其販賣Avastar 88W8897晶片並提供產品資訊等,讓前述晶片被裝設在Microsoft之Xbox One®遊戲機產品中,並由Microsoft販賣給美國境內消費者來使用,這樣的行為是間接侵害了NXP的專利權利。
 
NXP主張權利之四件系爭專利內容如下:
美國專利編號US 5,939,791,名稱為「用於積體電路之導電互連(Electrically conductive interconnects for integrated circuits)」,於1999年8月17日核發,原始權利人為VLSI Technology, Inc.,其於1999年為Koninklijke Philips Electronics N.V.所併購;
美國專利編號US 7,039,133,名稱為「具備用來與一接收資料流進行同步之裝置的資料載體(Data carrier having means for synchronization with a received data stream)」,於2006年5月2日核發,原始權利人為Koninklijke Philips Electronics N.V.;
美國專利編號US 8,185,050,名稱為「在一藍牙裝置與一無線區域網路裝置間的並存裝置通訊(Coexistance device communication between a Bluetooth device and a wireless local area network device)」,於2012年5月22日核發;
美國專利編號US 8,203,432,名稱為「讀取複數之無接觸資料載體的方法、包括一防碰撞機制(Method of reading a plurality of non-contact data carriers, including an anti-collision scheme)」,於2012年6月19日核發。
 
面對競爭對手發動專利訴訟攻勢,Marvell亦提起專利侵權告訴來還擊。在2015年2月2日,Marvell向美國加州中區聯邦地院起訴,控告NXP所製造販賣之NFC控制器、無限微控制器、LIN收發器等晶片產品,直接與間接侵害了Marvell所擁有之四件專利權利。
 
Marvell主張權利之四件系爭專利內容如下:
美國專利編號US 8,171,309,名稱為「安全記憶體控制存取(Secure memory controlled access)」,於2012年5月1日核發。Marvell主張,NXP之PN65T NFC控制器IC、嵌入式安全元件 (embedded secure element) 產品與其他具備類似電路或類似功能的積體電路產品,至少就本件專利之請求項8構成侵權;
美國專利編號US 7,957,777,名稱為「無線區域網路機制之喚醒功能(Wake on wireless LAN schemes)」,於2011年6月7日核發。Marvell主張,NXP之PN547 NFC控制器IC與其他具備類似電路或類似功能的積體電路產品,至少就本件專利之請求項13構成侵權;
美國專利編號US 7,454,634,名稱為「用於無線網路裝置之節電裝置與方法(Power savings apparatus and method for wireless network devices)」,於2008年11月18日核發。Marvell主張,NXP之PN547 NFC控制器IC、JN5168無線微處理器產品與其他具備類似電路或類似功能的積體電路產品,至少就本件專利之請求項17構成侵權;
美國專利編號US 6,903,448,名稱為「電子封裝之高效能導線架(High performance leadframe in electronic package)」,於2005年6月7日核發。Marvell主張,NXP之TJA1021 LIN收發器產品與其他具備類似電路或類似功能的積體電路產品,至少就本件專利之請求項1構成侵權。
 
隨著蘋果發布Apple Pay以NFC技術解決iPhone及Watch在消費的線上支付問題之後,NFC解決方案大廠NXP半導體公司也變得火紅,接著NXP併購其他公司也成為另一市場觀察點:

NFC技術伴隨物聯網發展而快速成長,其被廣泛應用在汽車、智慧電視、智慧型手機、金融卡、電子身分證等產品或物件上。Marvell與NXP在NFC技術領域中可以說是正面交鋒且競爭激烈,例如兩家公司均看到ZigBee無線網路協定之發展潛力:Marvell在2014年推出三種分別支援 Wi-Fi、藍牙、ZigBee 的微控制器產品,讓物聯網廠商可以依照不同的連線規格需求選擇採用;而NXP則是在2014年6月加入ZigBee聯盟董事會(the ZigBee Alliance Board of Directors),推動全世界採用 ZigBee做為主要的無線網路、感應與控制標準。(2680字;表4)
