記憶體存取技術專利Micro Design控告宏碁、華碩等伺服器產品侵權

2014年月27日，營業處所設於美國德拉瓦州的專利授權公司Micro Design LLC(下稱Micro Design)，向美國德拉瓦州聯邦地院提起專利侵權告訴，控告我國電腦設備大廠宏碁(Acer Inc.)及其美國分公司Acer America Corporation(以下統稱宏碁)，其所製造販賣之伺服器產品，例如型號為Altos R350 F2 (查宏碁產品網頁並無此一型號，應為訴狀誤植)、Altos T350 F2、Altos AR580 F2等產品，侵害Micro Design所擁有、一項有關處理器透過共處理器存取記憶體之技術的專利權利。

Micro Design於本案起訴同日，向相同法院提起另外6起專利侵權告訴，控告華碩、聯想、Dell、Fujitsu、Cray、NEC等廠商的伺服器或工作站產品(例如華碩的ESC4000、聯想的ThinkStation C30與S30、Dell的PowerEdge R720、NEC的Express5800等)，侵害本案系爭專利權利。

本案系爭專利為美國專利編號US 7,437,535，名稱為「用來在一微控制器上發出儲存指令與載入結果資料之命令的方法與裝置(Method and apparatus for issuing a command to store an instruction and load resultant data in a microcontroller)」，於2008年10月14日核發，發明人為Alexander Joffe與Asad Khamisy，原始權利人則為Applied Micro Circuits Corporation (下稱APM)。

Micro Design在其訴狀上所載營業處所地址，與另一家專利授權公司Sequent Data, LLC相同(請參見本網站報導《藍光光碟寫入技術專利侵權Sequent Data控告華碩等多家廠商》)。Micro Design所委任的訴訟代理人Timothy Delvin，過去任職於Farney Daniels, PC(與多家專利授權公司有密切業務往來之德州律師事務所)的德拉瓦州辦公室，而現在其所隸屬的Delvin Law Firm LLC，該事務所在訴狀上所揭露的地址，與Farney Daniels, PC網站上所列之德拉瓦州辦公室地址仍為相同。

而營業處所設於德州的專利授權公司Net Navigation Systems, LLC (下稱Net Navigation)，在2014年4月23日向德州東區聯邦地院提起4起專利侵權告訴，其所委任的訴訟團隊便是來自Farney Daniels, PC。Net Navigation在前述訴訟中所主張的專利權利為US 6,625,122與US 6,434,145，這兩項專利之原始權利人為APM，而發明人或共同發明人則為Alexander Joffe，與本案系爭專利均為相同。

Alexander Joffe為MMC Networks, Inc.公司的創辦人，該公司於2000年被APM所併購。根據美國專利商標局(USPTO)的登記資料顯示，APM在2011年6月，將包括本案系爭專利、以及前述兩項Net Navigation在他案中主張權利之專利在內的48項專利權利，移轉給Net Navigation。而後本案系爭專利與其他13項專利在2013年7月被移轉給Clearwater Innovations, LLC，而本案系爭專利本身則在2014年6月由Clearwater Innovations, LLC移轉給Micro Design。 (1333字；表3)
