2015年6月19日，營業處所設於美國德州的專利授權公司Fellowship Filtering Technologies, LLC (下稱Fellowship Filtering)，向美國德州東區聯邦地院提起6起專利侵權告訴，控告6家網站或軟體公司，例如大陸網路搜尋引擎服務公司百度(被列為被告者為Baidu, Inc.、Beijing Baidu Netcom Science & Technology Co., Ltd.以及其美國分公司Baidu USA LLC)、交友網站eHarmony(eHarmony, Inc.)、軟體公司Cloudera, Inc.、Callidus Software, Inc.等，其在網站上所提供的內容推薦功能，或所供應協助使用者進行大數據分析的軟體或平台，其中所涉及到透過分析複數評價資料進行評價排序的運算系統，至少侵害了Fellowship Filtering所擁有之一件專利權利的請求項19與25。該系爭專利所描述的發明，透過比較一使用者與其他使用者間偏好的相似度，來推薦至少一個物件給該使用者的系統。
本案系爭專利為美國專利編號US 5,884,282，名稱為「自動化協作式篩選系統(Automated collaborative filtering system)」，於1999年3月16日核發，發明人與原始權利人為Gary B. Robinson (下稱Robinson)。根據Fellowship Filtering所提訴狀，Robinson為Fellowship Filtering的共同所有人(co-owner)，是位數學家並曾發明所謂「the Robinson Method」的統計分析方法，而該方法被使用在許多垃圾郵件篩檢過濾的技術。
而在2015年5月至6月期間，包括前述6起訴訟在內，Fellowship Filtering基於本案系爭專利權利共提起14起專利侵權告訴，控告包括IBM、Oracle、SAP、Adobe等知名公司在內的多家網站或軟體公司，被告所提供的內容推薦功能系統或者大數據分析軟體工具，使用到本案系爭專利所描述的評價運算系統，因此侵害系爭專利權利。
以Fellowship Filtering控告百度侵權的案件為例，Fellowship Filtering在其訴狀中主張，百度為美國最常被瀏覽網站的第50名，所營運的「百度推薦」網站提供網站內容推薦工具，而所營運的「今晚看啥」視頻網站提供電影推薦系統，均侵害本案系爭專利權利。
Fellowship Filtering控告百度的訴狀長達50頁，詳述系爭專利的發明價值以及其被引用的狀況。不過更值得關注的是，Fellowship Filtering在其訴狀中花了相當篇幅來說明，系爭專利並非抽象概念(a patent ineligible abstract idea)而是具專利標的適格性(patent eligible)的發明，例如強調其並非指涉任何組織人類活動的方法(method of organizing human activity），並非將既知的商業方法應用在通用功能之電腦上，而是提供立基於電腦技術、解決在透過電腦網路推薦產品或內容之技術領域中特定發生之問題的解決方案，其無法由人類透過紙筆來完成，其具備發明概念(inventive concept)且電腦系統之使用為實施系爭專利發明的重要一環等。由此觀之，Fellowship Filtering應是意識到，系爭專利發明的專利標的適格性會受到相當質疑。
根據德州公司登記資料，本案原告Fellowship Filtering登記設立日期為2014年11月13日。而Fellowship Filtering在其訴狀中陳述，其除了Robinson外，還雇用了一名德州的技術分析師，而做為一間設籍德州的小公司，必須依賴專利保護來有效授權其技術並營運其業務。 (1238字；表3)
