MLR, LLC在美控告Acer產品侵犯無線行動通訊相關專利

2012年7月13日,一家設立於美國維吉尼亞州、擁有無線通訊技術相關專利組合之技術研發與專利授權公司MLR, LLC (下稱MLR),向美國維吉尼亞州東區聯邦地院提起專利侵權告訴,控告台灣Acer, Inc.及其美國分公司Acer America Corp. (下稱Acer)在美國境內所販售之筆記型電腦、平板電腦等產品,其所搭載之無線通訊功能,侵犯多項MLR所擁有之無線通訊網路與行動通訊裝置相關專利。

本案系爭專利如下:

美國專利編號US 7,386,322、US 6,134,453、US 6,934,558與US 5,854,985,名稱均為「具可適性之全模式無線電裝置與通訊方法(Adaptive omni-modal radio apparatus and methods)」,分別於2008年6月10日、2000年10月17日、2005年8月23日與1998年12月29日核發,發明人為MLR之總裁Charles M. Leedom, Jr.以及Joseph B. Sainton和Eric J. Robinson兩人;

美國專利編號US 7,343,173與US 6,961,584,名稱均為「階層化、多模式無線通訊系統與方法(Tiered wireless, multi-modal access system and method)」,分別於2008年3月11日與2005年11月1日核發,發明人為Charles M. Leedom, Jr.。

MLR之靈魂人物Charles M. Leedom, Jr.擁有技術研發能力且具備律師資格。MLR以其無線通訊專利組合、過往已提起數起專利侵權告訴,例如其分別於2008年7月28日與2009年9月10日向本案同一法院提告,控告Motorola, Inc.與中國中興通訊(ZTE Corporation)侵犯其專利(案號分別為2:08-cv-00357-HCM-FBS以及1:09-cv-01023-LMB-TCB),而這兩案均以和解收場。(674字;表2)
