LED照明裝置專利訴訟 Philips控告iGuzzini侵權

2015年5月22日，LED照明營收排名為全球第一的Koninklijke Philips N.V公司 (下稱Philips)，向美國紐約州南區聯邦地院提起專利侵權告訴，控告義大利照明公司iGuzzini Illuminazione S.p.A.及其美國分公司iGuzzini Lightining USA, Ltd.與iGuzzini Lightning North America, Inc.(下稱iGuzzini)，其所製造、販賣、進口至美國境內的LED照明裝置(LED Lighting Devices)產品，侵害Philips所擁有之5件專利權利。

 

本案五件系爭發明專利內容如下：

• 美國專利編號US 6,094,014 (’014專利)，名稱為「電路配置與以該電路配置所提供的信號光源(Circuit arrangement, and signaling light provided with the circuit arrangement)」，於2000年7月25日核發。Philips主張，包括但不限於iGuzzini的Woody LED產品侵害本件專利權利；
• 美國專利編號US 6,250,774 (’774專利)，名稱為「照明設備(Luminaire)」，於2001年6月26日核發。Philips主張，包括但不限於iGuzzini的Laser Blade崁燈(downlight)產品、Primopiano投射燈(projector)產品、Woody LED產品等侵害本件專利權利；
• 美國專利編號US 6,577,512 (’512專利)，名稱為「用於LEDs的電源供應(Power supply for LEDs)」，於2003年6月10日核發。Philips主張，包括但不限於iGuzzini的Palco LED產品、Primopiano投射燈產品等侵害本件專利權利；
• 美國專利編號US 6,586,890 (’890專利)，名稱為「具備脈衝寬度調變輸出之LED驅動電路(LED driver circuit with PWM output)」，於2003年7月1日核發。Philips主張，包括但不限於iGuzzini的Palco LED產品、Primopiano投射燈產品等侵害本件專利權利；
• 美國專利編號US 7,802,902，名稱為「LED照明固定器(LED lighting fixtures)」，於2010年9月28日核發。Philips主張，包括但不限於iGuzzini的Palco LED產品侵害本件專利權利。

 

Philips基於在LED照明領域所擁有的專利組合優勢，對在美國市場的競爭對手提起專利侵權訴訟。例如：

• 2015年3月20日，Philips便向美國麻薩諸塞州聯邦地院起訴，控告美國燈飾照明公司Troy-CSL Lighting, Inc.的LED照明裝置產品，侵害Philips所擁有之7件專利權利，其中包括’014專利與’774專利(案號為1:15-cv-11053-WGY)。
• 2014年5月27日，Philips亦曾向麻薩諸塞州聯邦地院起訴控告比利時戶外照明設備公司Schréder SA及其美國分公司Schreder Lighting LLC，其LED照明裝置產品侵害Philips的12件專利權利，其中包括’014專利、’774專利、’512專利與’890專利(案號為1:14-cv-12282-IT)，而該案於2014年10月24日以兩造和解收場。
• 在2012年10月11日，美國照明設備公司Technical Consumer Products, Inc.(下稱TCP)，向美國俄亥俄州北區聯邦地院提起確認之訴，聲請法院宣告Philips之8件專利無效或權利未受TCP之LED照明產品所侵害，其中包括’512專利與’890專利(案號為1:12-cv-02546-CAB)，不過該案已於2014年1月6日以兩造和解收場。(1380字；表2)
