2015年7月1日Personalized Media Communications, LLC，於美國德州東區聯邦地方法院(Texas Eastern District Court)向TPV(冠捷)和VIZIO(瑞軒)提起專利侵權訴訟，指控該些廠商之數位電視產品侵害PMC所擁有的US7747217B1、US7752649B1、US7752650B1、US7764685B1、 US7769344B1、US7783252B1 、US7810115B1 和US7856649B1等八項美國專利組合。

原告Personalized Media Communications, LLC創建於1981年，公司創辦人John C. Harvey，亦為系爭專利組合之發明人之一，該公司主要提供個人化資料演示(Personalized Presentation of Content)、互動程式(Interactive Programming)、多媒體接收器控制 (Control of Multimedia Receivers)、資料傳輸(Delivery of Content)與自動化系統(System Automation)等系統控制技術之授權，該公司亦曾對Zynga、Motorola等多家公司提起專利訴訟，目前尚在進行中之訴訟對象包括Amazon等公司(參見表五)。

目前接受該公司授權者包括Cisco、Motorola、Sony等公司[註]。該系爭專利組合目前已有108件專利，不過值得注意的是，在原告提起本案的前兩天，船井電機股份有限公司(Funai)於美國達拉威聯邦地方法院(DISTRICT COURT OF DELAWARE)對原告的US7747217B1、US7752649B1和US7752650B1三件美國專利提起確認之訴(Declaratory Judgment)。本案原告主張被告設計、製造和組裝了疑似侵權產品，然後為販賣之要約、販賣和為上述目的而進口之疑似侵權產品而侵害原告所擁有之系爭專利；此外原告引用35 U.S.C. § 299認為本案被告有得合併訴訟的要件(屬對於多方合併或分離的救濟權且所有被告有相同的事實問題)，而請求合併審判並請求法院判被告惡意侵權等。

原告所主張受侵害系爭專利組合之請求項共有八項，發明人皆為John Christopher Harvey和James William Cuddihy，並皆由發明人讓與給原告，並皆由原告一直所有。整理如下：

美國US7747217 B1號專利「Signal processing apparatus and methods (信號處理裝置及其方法)」之請求項38，本專利於2010年6月29日公告獲准，申請號US08/487,526，申請日1995年6月7日，優先權日1981年11月3日，共有56項專利請求項，使用於輸出多媒體圖像於接收端的方法；用途包括但不限於輸出多媒體圖像於私人住宅、辦公室和如電影院、酒店和經紀公司之商業場所。優點為在幾個用戶端之多媒體圖像的單點對多點傳輸導致同時用戶指定信息的產生；在發送端勿需私人信息且任何其他用戶端無用戶信息是可用的；缺乏可組合用戶指定的信息進入電視或無線電廣播節目能力之接收端可以在沒有修改下繼續進行。
美國US7752649B1號專利「Signal processing apparatus and methods (信號處理裝置及其方法)」之請求項1，本專利於2010年7月6日公告獲准，申請號US08/449,097，申請日1995年5月24日，優先權日1981年11月3日，共有102項專利請求項，使用於如電視，收音機和電腦之視頻接收機用於處理視頻信號的方法。優點為擴大系統的功能而於重新編程操作系統中提供靈活性和方便性；嵌入式信號可以從電視傳輸自動地被刪除；外部設備的連接或致動或調諧可被控制。預先錄製的節目可以被重新發送且編程的解密是可以控制的。
美國US7752650B1號專利「Signal processing apparatus and methods (信號處理裝置及其方法)」之請求項18，本專利於2010年7月6日公告獲准，申請號US08/460,711，申請日1995年6月2日，優先權日為1981年11月3日，共有33項專利請求項，使用於接收站用於電視信號處理的方法。優點為該方法允許確保用戶之使用便利和隱私；該方法允許單獨傳播傳輸來致能於一組用戶端的相關用戶特定信息之週期性組合，因而將用戶自己的信息和傳播資訊整合來提供如電視之強大通信媒介的使用。
美國US7764685B1號專利「Signal processing apparatus and methods (信號處理裝置及其方法)」之請求項63，本專利於2010年7月27日公告獲准，申請號US08/459,522，申請日為1995年6月2日，優先權日為1981年11月3日，共有203項專利請求項，使用於如電視、電腦和安裝在家庭之收音機、辦公室或如劇院、酒店或經紀公司之商業機構之編程接收站而在廣播硬拷貝、計算機通信、計算機處理、電子通訊、調制、監視和編程計量使用的領域可使用之方法。優點為於接收機端進行編程來待用戶使用以電子傳輸的音頻和視頻；多通道通信被自動組織；數據和控制指令被容易地傳送到不同的設備；因為於發送端沒有需要私人資訊而確保用戶的隱私；用戶特定信息以不會干擾電視或廣播節目的顯示或接收的方式而結合入電視或無線電廣播節目；可以可靠地和方便地監視編程傳送的時序；以減少處理的複雜性而訊息可迅速地發送、檢測和執行。
美國US7769344B1號專利「Signal processing apparatus and methods (信號處理裝置及其方法)」之請求項1，本專利於2010年8月3日公告獲准，申請號為US08/442,383，申請日1995年5月16日，優先權日1981年11月3日，共有13項專利請求項，使用於重編程接收端而用於接收電視或廣播節目的方法。優點為通過於幾個用戶端之用戶指定信息的同時產生而執行簡單單點對多點傳輸，以便接收端的重編程過程變得容易；用戶自己的資訊通過打開電視接收器和調諧到一個特定的通道下可在高度複雜的方式下進行處理；既然複雜的處理從用戶處隱藏，重編程過程是透明的；於發送端無需私人資訊，且於任何其他用戶端無需要用戶的資訊，使私密性得以被保持。缺乏對用戶特定的信息組合入電視或無線電廣播節目能力的接收端可不加修改而繼續接收和顯示電視或廣播節目，且於一般節目中沒有改變或任何信號的出現。於接收端重新編程的簡單度和速度是通過設計的信號處理裝置和同時最小化選擇性處理的需要來實現的。
美國US7783252B1號專利「Signal processing apparatus and methods (信號處理裝置及其方法)」之請求項37，本專利於2010年8月24日公告獲准，申請號US08/447,908，申請日1995年5月23日，優先權日1981年11月3日，共有52項專利請求項，使用於重編程接收端的方法，如視頻/計算機結合之媒體用戶端。優點為提供有用於發送標準化程式能力之接收端，標準化程式對用戶播放和理解而言是非常簡單。
美國US7810115B1號專利「Signal processing apparatus and methods (信號處理裝置及其方法)」之請求項1，本專利於2010年10月5日公告獲准，申請號為US08/459,216，申請日1995年6月2日，優先權日1981年11月3日，共有46項專利請求項，使用於以基於電視信號和電視節目的控制清單於接收端控制設備而從網絡選擇性接收電視信號的方法。優點為該方法能夠提供編程通訊的一個統一的系統，從而促進有效經濟的規劃和決策；該方法能夠應用嵌入電視信號於編程中，使得嵌入式信號不經意從編程分離，從而抑制自動處理並在編程中於精確的時間發生，且接收機端裝置的同步操作來時序編程傳輸和以方便的方式監視電視信號；於信號處理過程中的方法能夠構成SPAM信號的資訊，從而通過減少報頭、執行段和儀表監視器段而提供以最快的方式發送，檢測和執行之緊湊資訊和控制消息。
美國US7856649B1號專利「Signal processing apparatus and methods (信號處理裝置及其方法)」之請求項9，本專利於2010年12月21日公告獲准，申請號US08/449,523，申請日1995年5月24日，優先權日1981年11月3日，共有16項專利請求項，使用於可編程接收端而基於有線電視訊令之用於接收節目和資訊的方法。優點為該方法允許多通道通信的自動組織和傳輸標準化編程，傳輸標準化編程對用戶播放和了解是簡單的；該方法於給定的用戶端允許相同的信息流給不同裝置中的數據和控制指令的傳輸；該方法於一組用戶端允許對用戶指定信息的同時產生之簡單單點對多點傳輸；該方法允許用戶通過打開電視接收器和調諧到一個特定的通道來以高度複雜的方式處理自己的資訊。該方法於傳輸端不需要私人資訊且於其他用戶端不需要用戶資訊而接收節目和資訊。

系爭專利組合之專利家族領域涉及用於雲端運算系統的關鍵技術；原告曾以該專利家族提起多次訴訟訴訟，可見原告對此一專利家族的專利性和實施權極有信心。該些專利申請專利範圍用詞上位而導致保護範圍可能會擴張到極大，一方面而言，殺傷力極大，另一方面也極可能遭受有效性的挑戰，船井電機股份有限公司(Funai)針對原告也有關本案的US7747217B1、US7752649B1和US7752650B1三件美國專利提起確認之訴(Declaratory Judgment) ，其中包括主張該三件專利不符美國專利授與要件的要求因而全請求項皆為無效！

據RPX訴訟資料顯示，原告將部分系爭專利專屬授權給RPX會員。由此可見，原告與RPX應該有某種程度的合作關係。

原告以系爭專利組合中有關數位電視接收應用之請求項控告被告，結果是如原告所願，或被告會如船井電機一般提起確認之訴，宣告原告之系爭專利組合不符美國專利授與要件的要求因而全請求項皆為無效，值得觀察！(3580字；表6)
