DVD6C標準專利訴訟三菱、松下、三洋、華納控告World Media Group侵權

2014年4月8日，總公司位於日本的三菱、松下、三洋及總部在加州的華納兄弟家庭娛樂公司(下稱原告)向德州北區聯邦地方法院(Texas Northern District Court)控告World Media Group Inc(下稱WMG) 和Crystal Clear Media Group LLC(下稱CCMG)侵權，認為被告銷售的DVD產品侵犯原告所有之8項專利。被告WMG的總部在印第安納州，但其廣告透過www.worldmediagroup.com可見於德州達拉斯，且CCMG為WMG完全擁有之子公司，又在達拉斯設有銷售與服務中心，因此，原告認為德州北區聯邦地方法院對此案具有管轄權。

本案系爭專利共有8項，分別為：

• 美國專利編號US 6,549,717，專利名稱為「(Digital video signal record and playback device and method for giving priority to a center of an I frame)」，於年月日通過實體審查並公告，共有個權利項，其中第1、、項是獨立項。
• 美國專利編號US 6,539,164，專利名稱為「(Disk media, and method of and device for playing back information on or from a disk media)」，於年月日通過實體審查並公告，共有36個權利項，其中第1、13~17、21、28、33項是獨立項。
• 美國專利編號US 6,526,221，專利名稱為「(Data structure representing both program and command data)」，於2003年2月25日通過實體審查並公告，共有10個權利項，其中第1、3、6、8項是獨立項。
• 美國專利編號US 5,463,565，專利名稱為「軟體和播放器資料區塊格式(Data block format for software carrier and player therefor)」，於1995年10月31日通過實體審查並公告，共有21個權利項，其中第1、12、17項是獨立項。
• 美國專利編號US 5,907,659，專利名稱為「配置主圖像以使副圖像重合在主圖像上的多媒體光盤再生裝置及方法(Optical disc for which a sub-picture can be favorably superimposed on a main image, and a disc reproduction apparatus and a disc reproduction method for the disc)」，於1999年5月25日通過實體審查並公告，共有7個權利項，其中第1、4、7項是獨立項。
• 美國專利編號US 5,838,657，專利名稱為「高密度光碟及光碟撥放器(High density optical disc and optical disc player)」，於1998年11月17日通過實體審查並公告，共有9個權利項，其中第1、8、9項是獨立項。
• 美國專利編號US 5,896,367，專利名稱為「高密度光碟及光碟撥放器(High density optical disc and optical disc player)」，於1999年4月20日通過實體審查並公告，共有5個權利項，其中第1項是獨立項。
• 美國專利編號US 5,790,487，專利名稱為「光學信息記錄媒體與方法及利用它們的光學信息再生設備(Optical information recording medium, optical information recording method, and optical information reproducing apparatus utilizing the same)」，於1998年8月4日通過實體審查並公告，共有25個權利項，其中第1、2、3、13項是獨立項。

本案是關於標準專利(essential patent)的訴訟案，提供自有專利形成專利池(patent pool)的原告群希望被告能參與授權、支付權利金。第一個DVD的專利池是1998年由新力和飛利浦發起的DVD3C，LG和Pioneer隨之加入，提供一站購足(one stop shopping)DVD產品製造所需的標準專利。1999年形成第二個DVD專利池，DVD6C Licensing Group (下稱DVD6C)由9間公司組成，包含原告群三菱、松下、三洋、華納兄弟，以及日立、三星、夏普、JVC、東芝，授權範圍是DVD標準規格、+R或+RW規格，不包含MPEG-2、CSS(Content Scramble System)、CPPM(Copyright Protection for Pre-recorded Media)和CPRM(Copyright Protection for Recordable Media)、BD(Blu-ray Disc)等，MPEG-2標準專利由另一個標準專利聯盟MPEG LA授權。DVD6C的專利池共有16個項目，涵蓋DVD影音播放器、DVD光碟、編碼器、解碼器、+R與+RW光碟等，提供多國專利授權。

DVD6C網站提供授權金列表，並在FAQ表明不可議價。DVD光碟本身的授權金費率隨時間推移下降，現行費率為每片0.033美金，2015年1月1日起是每片0.03美金，調降的主因是市場價格大幅下滑；DVD播放器權利金費率是淨銷售價格的4%、上限為8美金，或每一播放器4美金，但新的授權合約生效後改為2美金，其他授權項目也各有自訂費率。原告在訴狀中表明，曾在提供給WMG的警告函裡標示DVD6C 的網站，關於授權範圍、權利金等資訊都可輕鬆地取得，因此認為被告為惡意侵權。至於一站購足式的授權模式是否構成壟斷？原告在訴狀中提到1999年美國司法部對DVD6C的商業審查函(Business Review Letter)提及該專利池結合互補性專利、降低生產成本，且包含的專利應為生產、製造DVD-ROM和DVD-Video Format時必要的[註1]。2002年時，DVD6C和DVD3C曾在中國掀起權利金風波，當時引發一連串對專利池行使權力的討論。

近期關於標準專利授權的訴訟案不僅這一樁。2014年2月6日，三菱、松下、新力、樂金飛利浦、LG和Thomson Licensing在加州中區聯邦地方法院控告ViewSonic侵權，案號2:2014cv00903。系爭專利共4項，US 5,606,539、US 7,376,184、US 5,784,107以及US6,097,759都屬於MPEG LA的MPEG-2標準專利池，原告要求ViewSonic參與授權並支付授權金。對ViewSonic來說，MPEG-2的標準專利訴訟還有2013年7月31日一樣由三菱、松下、樂金飛利浦和Thomson Licensing在佛羅里達州南區聯邦地方法院提起的案件，案號9:2013cv80743，共有7項系爭專利。(1500字；表2)
