2015年2月20日，專利控股公司SYCAMORE IP HOLDINGS LLC(以下稱Sycamore)向東德州聯邦地院控告ABB(Asea Brown Boveri)所屬兩家公司、AVDA(ADVA Optical Networking)所屬三家公司、Anritsu所屬四家公司和日立(Hitachi)所屬三家公司，共計12家公司涉嫌侵害其光通訊領域專利。不久之後於2015年3月5日，該Sycamore又向先前起訴法院控告愛立信(Ericsson)所屬兩家公司、Xtera(Xtera Communications, Inc.)公司、Transmode (Transmode Systems)所屬兩家公司和Menara(Menara Networks, Inc.)公司，共計6家公司涉嫌侵害其相同專利。
原告Sycamore所主張之受侵害之系爭專利，係於2005年10月4日公告獲准的美國第6,952,405號專利「Coding scheme using a transition indicator for signal transmission in optical communications networks(光通訊網路中用於信號傳輸而使用過渡指示符號之編碼方案)」，專利申請號為US 09/794,949，申請日期為2001年2月27日，共有20項專利請求項(其中5項為獨立項)。原始專利權人為Sycamore Networks, Inc.，之後先讓與給DRAGON INTELLECTUAL PROPERTY, LLC，再於2014年3月4日讓與給原告，本專利內容上涉及光通訊領域用於傳送已編碼資訊的相關技術，主要是藉編碼傳送資訊來降低頻寬需求，於控制資訊不損失下而更有效的傳送。系爭專利的原始專利權人(Sycamore)為一家千禧年網路泡沫之時代背景下，於Nasdaq上市而致力於光通訊網路的公司，有相當的技術實力和擁有數量不少的美國專利和少數中國專利，但也如同其他同時期的網路公司一樣，在網路泡沫後日漸式微。
依照德拉瓦州官方網站[註]，Sycamore IP公司是於2014年1月21日，設立於該州的美國有限責任公司，主營業所在內華達州的雷諾市(Reno)。在此系列的專利訴訟案前，尚未有積極的專利訴訟活動。
在這系列的案件中，Sycamore公司首先鎖定從事光通訊之ABB、AVDA、Anritsu和日立及其所屬共12家公司，控告產品直接或間接侵害其系爭專利，進而再控告從事光通訊之愛立信、Xtera、Transmode和Menara及其所屬共6家公司之產品直接或間接侵害其系爭專利。原告主要認為該些被告侵害原告所擁有系爭專利的申請專利範圍中之請求項1和請求項11，其中請求項1是方法專利，請求項11是產品專利。在訴狀中，原告指出該些被告不僅過去和正在運用製造、使用、為販賣之要約、銷售或未上述目的而進口之行為直接侵害系爭專利申請範圍中的文義或均等範圍，且進一步利用這些行為間接侵害系爭專利，而且為防止原告遭受不可回復的損害，原告聲請法院頒發永久禁制令，令該些被告公司停止繼續的侵權行為。原告請求法院判予損害賠償，並支付相關的費用，及停止其直接侵權行為和間接侵權行為。
結語
依照過去專利公司的訴訟模式，以相同專利或組合鎖定生產相同產品之廠商進行大規模控告已成為此類公司慣用的訴訟技倆，Sycamore公司是否會循此訴訟模式，於近日以系爭專利控告其他從事光通訊之廠商，值得密切注意！另外該公司是否會受讓Sycamore的其他專利另行興訟，就得看Sycamore公司的後續發展了。 (1861字；表3)
