2013年12月27日Eclipse IP LLC (以下稱Eclipse )，於美國加州中央聯邦地方法院(United States District Court, Central District of California)向Google, Inc.(以下稱Google)與Waze, Inc. (以下稱Waze)提起專利侵權訴訟，指控Google與Waze所提供的應用程式侵害Eclipse所擁有美國專利US8,068,037 (以下簡稱’037專利)。
Eclipse並無實際從事生產營銷，是一家專利授權公司，曾控告多家車用資訊服務商專利侵權(註一)。本案系爭專利’037專利名稱「用於通知系統之廣告系統與方法(Advertisement systems and methods for notification systems)」，其專利技術是關於一個或多個移動體的移動狀態通知系統之傳播方法。
Google為網際網路搜尋引擎、雲端服務巨擘。Waze則為一家創辦於以色列之行動地圖開發商，2013年Google以超過10億美元金額買下Waze，以拓展其行動地圖領域業務。
Eclipse指控Waze的社群導航應用程式，以及Google的Google Maps應用程式都是利用’037專利技術，Waze與Google未獲Eclipse授權，即逕自利用其專利技術，已直接侵害 ‘037專利權。且Waze與Google的應用程式除了執行專利技術外並無其他用途，而Waze與Google的用戶也因為使用該些侵權的應用程式而導致直接侵權，因此Waze與Google也成立誘導與幫助侵權。Eclipse請求法院核發永久禁制令，排除Waze與Google之侵權行為，並要求Waze與Google支付專利侵害損害賠償、授權金與訴訟相關費用。(559字；表2)
