網站販售筆電保護套產品之行為侵權Techshell控告eBay

2013年8月12日，一家營業總部設立於美國佛羅里達州、以設計販售適用於Apple等大廠筆記型電腦之保護套產品的Techshell, Inc.公司(下稱Techshell)，向美國佛羅里達州北區聯邦地院提起專利侵權告訴，控告美國知名拍賣購物網站eBay Inc.(下稱eBay)，其在網站上為販賣之要約以及販賣筆記型電腦保護套產品之行為，直接侵害或間接誘使他人侵害、Techshell所擁有之兩項專利權利。

本案兩項系爭專利為美國專利編號US 7,643,274(’274專利)與US 7,907,400(’400專利)，名稱均為「筆記型電腦保護套（Protective cover for laptop computer）」，分別於2010年1月5日與2011年3月15日核發，發明人均為Techshell之創辦人Haile Bekele，而’400專利為’274專利之連續案。Techshell在其訴狀中特別指明，eBay之行為是至少侵害了’274專利的請求項9-15以及17，還有’400專利的請求項9-25以及40-53。

Techshell在其訴狀中指出，本案系爭專利在2011年9月16日被提起、就所有請求項進行多方復審(inter parte reexamination)的請求(提起請求者為Incase Designs Corporation，下稱Incase)，但美國專利商標局(USPTO)認定，至少Techshell在本案中主張受到侵害的請求項並沒有不可專利之合理可能，所以USPTO拒絕就各該請求項進行複審，而各該請求項之有效性受到支持。

就’274專利，Techshell指出，其在2010年7月7日以書面告知eBay該專利之存在以及eBay之行為構成侵權，而eBay在同年8月4日以書面回應Techshell，表示需要 Techshell 提供法院發出的 injunction 判決, 或滿足 a. b. c. 三要件的聲明書 statement，eBay才能將第三者在eBay上所展售的商品下架。2013年5月14日，Techshell再度就主張eBay侵權一事聯絡eBay，但eBay回應仍與三年前相同，表示需要 Techshell 提供法院發出的 injunction 判決, 或滿足 a. b. c. 三要件的聲明書 statement，eBay才能將第三者在eBay上所展售的商品下架。

Techshell可說是相當積極在主張其所擁有之專利權利。在2010年5月11日，Techshell基於’274專利向本案相同法院起訴，控告其競爭對手、製造販售各式消費電子產品保護套產品的Hard Candy Cases, LLC構成侵權(案號為3:10-cv-00154-RS-MD)，而之後該案以和解收場。

2011年4月5日，Techshell基於本案相同2項專利向本案相同法院起訴，控告另一家製造販售保護套產品之公司Incase侵權(案號為3:11-cv-00165-MCR -CJK)，亦在同年5月19日起訴，控告美國消費電子零售商Best Buy為販賣之要約與販賣筆電保護套產品(特別是Incase之產品) 的行為構成侵權(案號為3:11-cv-00246-MCR -EMT)，而後該兩案被裁定合併審理並被移送訴訟至加州北區聯邦地院(案號為3:11-cv-04576-CW)。

在2011年11月，Techshell又基於本案系爭專利向本案相同法院起訴，分別控告Top10 Electronics Corp. (案號為3:11-cv-00528-MCR-CJK)、Osaka, Inc.(案號為3:11-cv-00559-RV-EMT)、jWIN Electronics Corporation(案號為3:11-cv-00556-MCR-CJK)等公司侵權。(1169字；表3)
