雲端儲存裝置專利訴訟Data Speed Technology LLC控告10多家公司

2013年4月16日，總部設立於美國德拉瓦州的Data Speed Technology LLC (下稱Data Speed)於德拉瓦州地方法院，指控於美國德拉瓦州設有辦公室與服務處的OPEN TEXT INC.(下稱Open text)之電子儲存裝置及服務侵犯其專利權，要求核發永久禁制令、損害賠償及訴訟律師費之補償。

而Data Speed除了於2013年4月16日對Open text提起訴訟外，針對同樣的專利，亦於2013年4月12日起，對於Microsoft, Oracle, IBM,Cisco,hp, EMC, Xerox, Sap, …等十餘家公司提告。(整理如表三)

本案系爭專利為美國專利編號US5,867,686，名稱為高速的即時資料儲存系統(High speed real-time information storage system)，於1999年2月2日獲證，於2013年2月14日轉讓給EMPIRE IP LLC，再於2013年4月2日轉讓給目前的專利權人Data Speed Technology LLC。

A method of providing memory access to a memory mass storage device by a plurality of computers, each functioning under an independent operating system, such method comprising the steps of: 一種大容量儲存裝置的存取方法,用於各自獨立作業的操作系統的多個計算機, 該方法包含以下步驟:

receiving a write access request identifying a memory space from a requesting computer of the plurality of computers by the memory mass storage device; 該儲存裝置從多個計算機中的其中一計算機接收一特定記憶體空間寫入一存取需求;

granting access and reserving the memory space for the exclusive use of the requesting computer and denying write access to the memory space by any other computer of the plurality of computers for the duration of the access grant to the requesting computer; and 允許存取並保留該記憶空間給予該計算機專屬使用權並拒絕寫入其他計算機的存取需求;

receiving a write access request and a required memory size from a second requesting computer of the plurality of computers. 接收寫入存取需求並獲得從多個計算機中第二個有存取需求的計算機所求的記憶體空間.

Data Speed Technology LLC
為一專利授權公司(Patent Holding Company)，也就是俗稱的NPE(Non-Practicing Entities)或專利蟑螂，本身並無生產製造產品，通常是透過專利的收購而擁有專利權，並常大規模對於相關產業提起訴訟，試圖獲得權利金收入。

OPEN TEXT INC.
於1991年創立，提供Enterprise Information Management (EIM)，企業資訊管理（E解決方案的領導者。使企業能夠發展業務，降低經營成本，減少資訊管理和資安相關的風險。

AIA修法後，根據35 USC § 299 Joinder of parties，除非是同一交易流程，或是被告間存在共通的事實，否則無法於單一程序中，對多個被告提起專利訴訟，目的是增加NPE提起訴訟的成本，此條款雖被廠商視為日後可以減少被NPE提起訴訟的利多，但還是許多的NPE不計較成本依然提起訴訟，其嚇阻效果仍有待觀察。(670字；表3)
