ITC 337調查：Tela Innovations控告華碩、宏碁、微星、聯想、英特爾

加州的專利授權公司Tela Innovations於2018年12月19日，向美國國際貿易委員會（ITC）要求進行337調查(Docket #3358)，被調查的公司，包括：台灣業者華碩、宏碁、微星，及中國的聯想，還有美國的英特爾，指控這些被告公司輸往美國的特定積體電路產品（Certain Integrated Circuits and Products Containing the Same）侵犯其專利權，因此Tela請求ITC進行「337調查」，並發布相關禁止令。

Tela尋求對英特爾14奈米或更小的三柵極（Tri-Gate）積體電路及包含這些元件的產品實施進口禁令，這些產品包括微處理器，數據機、筆記型電腦，桌機和印刷電路板等。這些終端產品業者成為被告的原因，因他們的PC/NB/Tablet產品使用到Intel涉嫌侵權的處理器，因而受到牽連。

由於，Tela Innovations是專利授權公司，也就是俗稱專利流氓或NPE公司，因而本案可能進入快審程序。根據美國ITC針對日漸嚴重的“專利流氓”(Patent Troll)議題提出有效的解決方案，針對選定某些案件，在立案後100天之內對於某些決定性的問題先進行早期的裁決(Early ID)，包括早期的聽證會，以減少不必要的訴訟，節省訴訟時間和成本。也就是說，100天內進行早期裁定Early ID，特別對某些選定的提訴公司(原告)，確認其必須證明在美國有重要的業務存在(domestic industry)、進口事實(importation)以及具有起訴身份之立場(standing)。

隨著中國業者走出中國之後，近年中國遭到美方337調查次數逐年增多。統計顯示，自2007年迄今美國發起的337調查中，涉及中國的案件幾乎占70%，成為337調查最多的國家。

本案，同一天，Tela Innovations同時於Delaware法院控告聯想，也於北加州法院控告台灣三家業者，而Tela Innovations與Intel之間專利糾紛，其實早於2018年5月就發生互控事件。主要涉及5件系爭專利：
10141334：Semiconductor chip including region having rectangular-shaped gate structures and first-metal structures
10141335：Semiconductor CIP including region having rectangular-shaped gate structures and first metal structures
7446352：Dynamic array architecture
7943966：Integrated circuit and associated layout with gate electrode level portion including at least two complimentary transistor forming linear conductive segments and at least one non-gate linear conductive segment
7948012：Semiconductor device having 1965 nm gate electrode level region including at least four active linear conductive segments and at least one non-gate linear conductive segment

Tela Innovations, Inc公司成立於2005年，總部位於加州。專為集成電路提供光刻優化設計解決方案。該公司為ASIC和SoC設計提供物理IP產品; 通過其柵極長度偏置技術，設計服務參與或軟件許可模型，以及功率優化技術解決方案。(586字；圖1)
