2013年10月02日，總部位於美國科羅拉多州的數位電子看板公司Four Winds Interactive LLC (“FWI”)於美國科羅拉多州地方法院，對總部位於美國佛羅里達州的Activision TV, Inc. (“Activision”)，提起專利確認之訴(Declaratory Judgment)，要求法院審理Activision的專利之有效性(invalidity)，以及其數位電子看板解決方案相關技術不侵犯Activision的專利權。
FWI於訴狀指出，Activision近年來，不斷騷擾FWI以及FWI的客戶，認為FWI的產品侵犯其專利權，並要求支付權利金，FWI也從多次與Activision開會討論相關議題，但未達成共識。2013年8月29日，Activision於美國科羅拉多州地方法院對FWI的客戶Inverness Properties LLC與Kats on Market, Inc.提起專利訴訟(案號分別為1:2013-cv-02334與1:2013-cv-02332)。FWI認為Activision企圖搗亂市場引起紛爭，因而造成FWI相當大的困擾。
本案系爭專利共四項，為同一專利家族，相關資料整理如下:
- 美國專利編號US 8,330,613，名稱為遠端控制電子顯示系統(Remote control electronic display system)，於2008年5月6日提出申請，2012年12月11日獲證，目前專利權人為Activision TV, Inc.。
- 美國專利編號US 7,369,058，名稱為遠端控制電子顯示系統(Remote control electronic display system)，於2004年6月21日提出申請，2008年5月6日日獲證，目前專利權人為Activision TV, Inc.。
- 美國專利編號US 6,384,736，名稱為遠端控制電子顯示系統(Remote control electronic display system)，於1999年4月21日提出申請，2002年5月7日日獲證，目前專利權人為Activision TV, Inc.。
- 美國專利編號US 6,215,411，名稱為遠端控制電子顯示系統(Remote control electronic display system)，於2000年2月8日提出申請，2001年4月10日獲證，目前專利權人為Activision TV, Inc.。
Four Winds Interactive LLC，總部位於美國科羅拉多州，創立於2005年，為數位電子看板相關軟硬體及服務的主流公司，其下有280位員工。
Activision TV, Inc.，總部位於美國佛羅里達州，其主要著重於數位平面顯示器之銷售及政府採購案，同時也積極主張專利權及收取權利金相關業務。
