2015年09月28日，註冊於美國伊利諾州芝加哥市的私人網路雲端服務公司Nextpoint Inc.向美國伊利諾州北區地方法院起訴美國電腦巨頭Hewlett-Packard Company侵害其訴訟證據雲端管理軟體專利US8,447,731號（下稱’731號專利）專利權。
本案系爭專利 ‘731號專利名稱為「資料管理的方法與系統（Method and system for information management）」，申請日2009年09月02日，獲證日2013年05月21日，優先權日2006年07月26日。與’731號專利相關的申請案至少有12/098,317、11/828,969、12/059,636、 11/828,969等四案，惟該些專利均未獲證。
‘731號專利技術略為：接收並儲存一電子儲存資訊於一個虛擬儲存位置；分解該電子儲存資訊至複數資訊區塊中，其中各該複數個資訊區塊包含有「一組依據執行態樣的需求，得用以一次性執行的最小區塊資訊（the smallest block of information to be processed at one time depending on type of processing required）」；透過一個供給複數個虛擬電腦（virtual computers 6253）的雲端運算網路（virtual computing cloud 6200）之架構，提供複數個執行指令至各該複數個虛擬電腦，指示一個儲存有該已執行電子儲存資料的主要資料庫（a primary database 6152），以開放電子儲存資料給一個使用者，進而執行該些複數電子儲存資訊的資訊區塊中的下一個可執行區塊。
原告Nextpoint Inc.於2001年設於美國芝加哥市之私人科技公司，主要業務係針對政府及律師事務所，以雲端軟體伺服器架構，提供多用戶平台存取電子證物及電子訴訟蒐證程序之管理（electronic evidence management and electronic discovery）。
被告Hewlett-Packard中文名稱為惠普，係一家總部設在美國加州，於那斯達克上市（NYSE：HPQ）的跨國科技公司，其主要研發，生產電腦、伺服器、各類3C週邊產品。日漸亦轉向軟體及雲端服務業務。
原告於起訴狀陳稱，本案爭議專利’731號之保護技術係涉及「訴訟資料於雲端電腦網路之蒐集與管理的方法與系統（a system and method for collecting and managing trial information using a cloud based computer network ）」，由於被告的「訴訟證據雲端管理產品與服務（cloud based eDiscovery products and services）」使用了上述技術內容，侵害了’731號專利之專利權，故請求法院確認被告侵權、要求被告停止侵害，並賠償原告之損失。(928字；表1)
