通訊管理系統專利訴訟 VeriFire控告D-Link等防火牆產品侵權

圖、通訊管理系統專利訴訟 VeriFire控告D-Link等防火牆產品侵權
 
2015年6月3日，營業處所設於美國德州的專利授權公司VeriFire Network Solutions, LLC (下稱VeriFire)，向美國德州東區聯邦地院提起18起專利侵權告訴，控告多家公司所製造販賣之防火牆(firewalls)產品，侵害VeriFire所擁有之一件專利權利。
 
在VeriFire所起訴的18起專利侵權告訴，被控侵權的公司包括：台廠友訊科技的美國分公司D-Link Systems, Inc.(下稱D-Link)、陸廠華為的美國分公司Huawei Technologies USA Inc.與Huawei Device USA Inc.、網路設備供應商Cisco Systems, Inc.與Netgear, Inc.、電腦硬體設備廠Dell Inc.與Hewlett-Packard Company、網路安全設備供應商WatchGuard Technologies, Inc.與Fortinet, Inc.、網路安全解決方案供應商Check Point Software Technologies Ltd.與McAfee, Inc.等。
 
本案系爭專利為美國專利編號US 8,463,727，名稱為「通訊管理系統與通訊管理方法(Communication management system and communication management method)」，於2013年6月11日核發，原始權利人為日本公司Duaxes Corporation(下稱Duaxes)，發明人則為該公司董事長(代表取締役)名古屋貢(Nagoya Mitsugu)以及伊波源太(Iha Genta)。根據其網站資訊(http://www.duaxes.co.jp/index.html，2009年9月後已停止更新)，Duaxes在日本有推出UNSAPS系列的網路安全設備產品。
 
以VeriFire控告D-Link一案為例，VeriFire在訴狀中指出，D-Link所製造販賣的網路安全設備產品，包括防火牆產品，以及內建有安全設備的網路設備產品，其所做為通訊管理系統所具備的功能，至少侵害了系爭專利之請求項1。VeriFire在其訴狀中所例舉出的D-Link被控侵權產品為D-Link的UTM防火牆系列產品。
 
根據德州公司登記資料，本案原告VeriFire登記設立日期為2015年2月18日。而根據美國專利商標局(USPTO)的專利權利轉讓資料，系爭專利權利是在2015年3月11日由Duaxes轉讓給VeriFire。(876字；表3)

an output unit which, when there is detected communication data complying with a rule stored in the first rule database, outputs the communication data;
 一輸出元件，其在被偵測之通訊資料符合儲存在前述第一規則資料庫中的規則時輸出該通訊資料
an update unit which accepts a change in a rule for extracting specific communication data to analyze a communication data with reference to other communication data when the communication data against which a warning has been issued by reason that the communication data does not match the rule stored in the first rule database is analyzed;
 一更新元件，其接受用來擷取特定通訊資料之規則的變更，藉由參照其他通訊資料來分析一通訊資料，當被分析之通訊資料基於該通訊資料並不符合儲存在前述第一規則資料庫中之規則的理由而被核發一警告訊息
a second rule database which stores an updated rule changed by the update unit; and
 一第二規則資料庫，其儲存由前述更新元件所變更的更新後規則
a database server which transmits the updated rule changed by the update unit from the second rule database to the first rule database, and reflects in real time, the change in a rule.
 一資料庫伺服器，其從第二規則資料庫傳送由前述更新元件所變更之更新後規則置第一規則資料庫，並即時反映出規則之變更
