圖、個人健康紀錄APP專利訴訟LMG 3 Marketing控告Apple
2015年4月30日，LMG 3 Marketing and Development Corp. (以下稱LMG) 於美國聯邦紐澤西區法院提起專利訴訟，指控Apple Inc. (以下稱Apple) 於2014年所推出的行動裝置APP “Health App”以及”HealthKit”侵害LMG於2002年發明並獲得的2項美國專利，即US8,195,479 (以下稱’479專利) 與US8,195,480(以下稱’480專利)。
本案系爭專利如下：
- ‘479專利名稱為「保有個人醫療紀錄於自有攜帶記憶裝置(Maintaining Person’s Medical History in Self-Contained Portable Memory Device)」，於2012年6月5日獲准公告，專利申請號為11/779,645，申請日2007年7月18日，共有22個權利項，其中第1、21項為獨立項。發明人為Michael Lubell; Robert Guinta; Albert Moran, Jr.，所有權人為LMG 3 Marketing and Development Corporation。
- ‘480專利名稱為「保有個人醫療紀錄於攜帶記憶裝置之系統 (System for Maintaining Person’s Medical History in Portable Memory Device)」，於2012年6月5日獲准公告，專利申請號為11/779,664，申請日2007年7月18日，共有5個權利項，其中第1項為獨立項。發明人為Michael Lubell; Robert Guinta; Albert Moran, Jr.，所有權人為LMG 3 Marketing and Development Corporation。
LMG 3 Marketing and Development Corp公司為2000年於紐澤西州成立的軟體與產品開發公司，專長於醫療紀錄儲存裝置與應用程式軟體開發，擁有本案系爭之2件專利。在2002與2003年間，本案系爭專利之發明人意識到個人病歷的完整度在其面對新的醫療診斷與處置行為時的重要性，特別是面臨急救狀況時，進而開發能儲存個人醫療紀錄之隨身裝置，包括過敏資訊、緊急聯絡人、診斷、醫療計畫、處方、手術史、免疫紀錄、保險資訊、治療史與醫師連絡方式等。
在發明的過程中他們首度同時克服了資料安全與授權、多次重複存取與軟硬體相容等問題，並於2002年底推出產品名為MyRECS的原型裝置，且將此專利登記於其公司LMG。之後LMG又推出新款MyPMR裝置，授權於大陸生產並於美國各實體與線上通路販售。
LMG指出，Apple資深副總Craig Federighi在2014年的開發者大會上介紹Apple Health (包括Health App與HealthKit)，並宣稱開發者解決了資料安全與授權、重複存取與軟硬體相容等問題將造成醫療產業的革命，但其實早在10年前LMG已發現並提出解決方案。LMG進一步指出，Apple所宣稱HealthKit平台的先期使用者如杜克大學醫療系統 (Duke University Health Systems) 早在2012年已與LMG接觸並希望取得LMG本案系爭專利的授權。LMG認為，儘管Apple的產品功能更強大，但其中的核心技術確為LMG所擁有。而Apple唯一的貢獻，在於處理電子與醫療業中各醫療單位間病人資料不互通的問題。(1124字；表3)

In a system in which a person maintains his or her medical history in a portable, hand carried nonvolatile memory device comprising machine-readable memory having software comprising machine-executable instructions constituting a program executable by a general computer for (i) storing medical records in a secure database in the machine-readable memory of the portable, hand carried memory device, (ii) updating the medical records in the secure database in the machine-readable memory of the portable, hand carried memory device, and (iii) providing access to the medical records in the secure database in the machine-readable memory of the portable, hand carried memory device, a method for recovering that person's medical history in the event of loss, destruction, or damage of the device, the method comprising the steps of:
