南韓公司MSTG以手機相關標準技術開發及其相關智財授權為主的公司。於2009年6月18日於美國伊利諾州北區聯邦法院，向7家手機及通信業者提告，據其訴狀指出，被告7家公司任意和故意侵犯了(willfully and deliberately in violation)MSTG所主張的美國專利三件(系爭專利：US5,920,551、US6,198,936、US6,438,113)之製造、使用、銷售、行銷及進口等行為，見表一。該訴訟案，係有關於3G手機通信技術，被告7家手機及通信業者：宏達電、宏達電美國公司、摩托羅拉、Palm、Sanyo、Sprint、T-Mobile。其中Sprint及T-Mobile這2家通信業者，係因提供涉案手機的服務及產品銷售行為而挨告。
MSTG公司所取得該三件系爭專利皆是接受讓與自韓國電子通訊研究院（Electronics and Telecommunications Research Institute, ETRI）。ETRI屬於韓國政府補助進行技術開發的研究機構，但ETRI所開發技術集中於光通訊、無線通訊、數位匯流與關鍵電子零組件開發等。ETRI專注於技術研究開發，對於專利授權策略模式，也可參考【韓國專利策略出國打仗去，ETRI在美控告HTC侵權啟示】。
