海事用聲納成像裝置專利ITC調查案 Johnson Outdoors控告Garmin

Electronics, Inc., d/b/a Humminbird (以下合稱Johnson Outdoors)向美國國際貿易委員會(United States International Trade Commission, 以下簡稱ITC)提告，請求ITC依1930年美國關稅法337條款調查Garmin International, Inc., Garmin North America, Inc., Garmin USA, Inc., Garmin Corporation(以下合稱Garmin)於美國製造販賣之海事用聲納成像裝置，違法侵害Johnson Outdoors所擁有之US7,652,952 (以下簡稱’952專利)、US7,710,825 (以下簡稱’ 825專利) US7,755,974(以下簡稱’974專利)等3項美國專利事件。

原告Johnson Outdoors成立於1985年，總部在威斯康辛州，主要製造、銷售季節性戶外休閒產品，包括釣魚、潛水、划船、登山及露營等用品。Johnson Outdoors Marine Electronics, Inc., d/b/a Humminbird為其海洋電子裝置事業部，提供聲納與GPS設備、釣魚馬達等產品。Johnson Outdoors同時也生產軍用帳棚、量測儀表等軍用設備。

本案三項系爭專利都是Johnson Outdoors自行開發取得，’952專利名稱「安裝於水上航行船隻之聲納成像系統(Sonar imaging system for mounting to watercraft)」；’ 825專利名稱「可顯示船隻位置之側向掃描聲納成像系統(Side scan sonar imaging system with boat position on display)」；’974專利名稱為「加強側向掃描聲納成像系統(Side scan sonar imaging system with enhancement)」，三項系爭專利皆與聲納探測影像技術相關。

被調查人Garmin(台灣國際航電)成立於1989年，主要產品為導航與通訊產品，產品線包括航空用、航海用、車用、行動式導航系統與裝置，為全球衛星定位導航系統的領導品牌之ㄧ。

Johnson Outdoors控告Garmin未經授權製造、販賣、進口與提供銷售利用系爭專利技術之海事用聲納成像裝置，直接與間接侵害其專利權。被控侵權產品包括聲納成像換能器(Garmin SideVti/DownVti sonar imaging transducer (part number O10-12089-00))、蜂鳴模組(Garmin GCV 10 sounder module)及相容之聲納顯示器(Garmin echo MAP, GPS MAP series sonar displays, 包括Garmin echo MAP 7Odvand 70s, GPSMAP 721, 72lxs, 741, 74lxs, 820, 820xs, 840xs, l020, l020xs and l04Oxs sonar displays)。

Johnson Outdoors除提出實證以舉證被調查人製造、進口與販賣系爭侵權產品之事實外，也強調Johnson Outdoors符合337調查案之「國內產業(domestic industry)」之要件，Johnson Outdoors全資持有之子公司Humminbird所研發製造的魚群探測器內之側向掃描聲納-Side Imaging系列產品，即是實施系爭3項專利技術之代表產品，Humminbird是系爭三項專利之專屬被授權人。Humminbird在美國境內投資設備生產、任用人員進行研發活動，且其商業活動也倚賴系爭專利技術之實施。Johnson Outdoors請求ITC核准發佈禁止被調查人侵權產品進口至美國之永久排除令(Permanent Exclusion Order)，以及禁止被調查人在美國境內對已進口之系爭侵權產品進行行銷、散佈、販賣或提供技術支援等行為之永久禁制令(Permanent Cease and Desist Order)，以遏止該侵權行為對Johnson Outdoors產生進一步的侵害。(1006字；表2)
