2014年7月3日CAP Co., Ltd. (以下稱CAP)於美國加州聯邦地方法院(the Northern District of California)向MICROSOFT CORPORATION (以下稱Microsoft)提起專利侵權訴訟，指控Microsoft所提供之軟體與作業系統，侵害CAP所擁有的RE42,196 (以下稱’196專利)、RE44,249 (以下稱’249專利)、US8,544,078(以下稱’078專利)3項美國專利。
CAP是一家韓國企業，目前持有3項美國專利，即為本案三項系爭專利，該三項專利皆轉讓自韓國最大安全軟體開發商INCA Internet Co., Ltd.：
- ’196專利名稱為「用以阻絕線上有害資訊，且計算其可讀介質之系統與方法(System and method for blocking harmful information online, and computer readable medium therefore)」，
- ’249專利名稱為「用以阻絕線上有害資訊之方法(Methods for blocking harmful information online)」，
- ’196專利與’249專利是US 7,062,552專利之再公告與衍生專利，兩者專利技術皆提供一種讓用戶可連接至一網路伺服器後，在網路上診斷、修正與阻斷線上電腦病毒等有害資訊之方法。
- ’078專利名稱「可允許被信任流程之彈性網路安全系統與方法(Flexible network security system and method for permitting trusted process)」，提供一種可經由網路連接之防火牆，自動增加或移除傳輸接口之技術。
CAP控告Microsoft所提供之作業與軟體系統，包括Windows XP, Windows Vista, Windows 7, Windows 8, Windows Server 2003, Windows Server 2008, Windows Server 2012, Microsoft Security Essentials, Forefront products, Network Inspection System (NIS) products including Microsoft Security Essentials, Forefront Endpoint Protection, System Center 2012 Endpoint Protection, Windows Defender等系統，皆已利用系爭3項專利技術。Microsoft未經CAP同意，即逕行利用其專利技術製造、使用、販賣與進口系爭侵權產品，已直接且間接侵害CAP專利權，CAP請求法院判決Microsoft直接、幫助與教唆侵害專利權，並要求Microsoft需支付專利侵害損害與訴訟相關費用。(690字；表2)
