2014年5月12日Virginia Innovation Sciences, Inc. (以下稱VIS)，於美國東維吉尼亞州聯邦地方法院諾弗克分院(United States District Court, The Eastern District of Virginia, Norfolk Division)向三星電子及其相關公司(包括Samsung Electronics Co., Ltd, Samsung Electronics America, Inc.及Samsung Telecommunications America LLC，以下合稱Samsung)提起專利侵權訴訟，指控Samsung所製造販賣之智慧型裝置侵害VIS所擁有的US 8,712,471 (以下簡稱’471專利)美國專利。
Virginia Innovation Sciences, Inc.是一家在維吉尼亞州註冊的公司，曾於2013年6月控告Samsung侵害其七項專利權(註一)，屬於非專利實施實體(NPE)。VIS在前次訴訟所主張之專利權，部份轉讓自Sellerbid, Inc.，Sellerbid Inc.是一中國無線通訊技術、射頻晶片研發與應用開發商，提供無線高速傳輸系統設備與解決方案。而在本次訴訟所主張之’471專利，原申請人與專利權人雖皆為VIS，但專利發明人卻與Sellerbid Inc.之專利技術發明人多有重複，可見VIS與Sellerbid Inc.合作緊密，且VIS可能即為Sellerbid Inc.之關係企業。
’471專利名稱為「用於顯示來自無線通訊網路之多媒體資訊之系統、方法與裝置(Methods, systems and apparatus for displaying the multimedia information from wireless communication networks)」，是一種轉換視頻資料，使其適用於移動裝置顯示之方法。
VIS控告Samsung所提供之智慧型手機中，所使用的可攜式產品高清連結(MHL )乃是利用系爭專利技術。Samsung未經VIS同意，即逕行利用其專利技術製造、使用、販賣與進口具有該功能之智慧型手機，包括Galaxy S5, Galaxy S4, S4 Active, S4 Zoom, Galaxy Note III, Galaxy Note II, and Galaxy S3等，已直接侵害VIS之專利權，VIS請求法院判決Samsung直接且惡意侵害專利權，並要求VIS需支付專利侵害損害、懲罰性賠償金與訴訟相關費用。(862字；表2)
