專利授權公司Rothschild GPS控告Nissan車載衛星導航系統侵權

2014年4月7日，營業處所設於美國佛羅里達州的專利授權公司Rothschild GPS Sharing Innovations, LLC(下稱Rothschild GPS)，向美國加州南區聯邦地院提起專利侵權告訴，控告日本跨國汽車大廠日產汽車的美國分公司Nissan North America, Inc.(下稱Nissan)，其所推出供購車者選擇、具備讓使用者可以用遠端裝置搜尋並傳送地點位置資訊至車載衛星導航裝置之功能的系統產品NissanConnectTM與Infiniti ConnectionTM，就Rothschild GPS所擁有之本案系爭專利權利、構成直接與間接(誘使)侵權。

本案系爭專利為美國專利編號US 7,917,285，名稱為「用於遠端輸入、儲存與分享定位資訊裝置位址的裝置、系統與方法(Device, system and method for remotely entering, storing and sharing addresses for a positional information device)」，於2011年3月29日核發，發明人為Leigh M. Rothschild (下稱Rothschild)，原始權利人為Reagan Inventions, LLC(下稱Reagan)。

Rothschild GPS Sharing Innovations, LLC是發明人Leigh M. Rothschild所設立，擁有60項專利，涵蓋領域包括電腦伺服器、3D顯示、GPS技術等。同時，設立有Rothschild Trust Holdings, LLC (下稱Rothschild Trust)公司並擔任常務董事(Managing Director)一職。Rothschild相當積極尋求透過專利授權活動來獲利，據悉其與Intellectual Ventures Management, LLC (IV)亦建立有合作關係，IV收購了部分其所擁有、與藍光技術或GPS技術相關的專利權利。

而根據美國專利商標局(USPTO)之資料，本案系爭專利曾移轉數次，包括Rothschild Trust、Reagan、Qaxaz LLC (下稱Qaxaz)以及本案原告等公司均曾擁有該專利權利，而其中除了Qaxaz之營業處所地址是位於德州外，其他公司在USPTO之權利移轉資料上所記載的地址均為一致，可想見這幾間公司應該均是Rothschild所成立的公司。

而在Qaxaz擁有本案系爭專利權利之期間，其曾於2011年6月2日向德拉瓦州聯邦地院提起兩起專利侵權告訴，分別控告BMW、Ford、GM、Mercedes-Benz、Toyota等車廠的車用衛星導航裝置(案號為1:11-cv-00491-RGA)，以及台灣國際航電(Garmin)等衛星導航設備業者所生產販售的衛星導航產品(案號為1:11-cv-00492-RGA)，侵害本案系爭專利權利。該兩起訴訟案件在2012年均告終結，以多數被告陸續與原告達成和解並合意撤銷訴訟收場。Rothschild GPS在其訴狀中指出，該兩起訴訟的結果是讓9家公司取得系爭專利之授權。(1024字；表2)
