2014年1月21日Genband US LLC (以下稱Genband)，於美國東德州聯邦地方法院馬歇爾分院(United States District Court, The Eastern District of Texas Marshall Division)向Metaswitch Networks Ltd, Metaswitch Networks Corp. (以下合稱Metaswitch)提起專利侵權訴訟，指控Metaswitch所提供的多項系統與服務，侵害Genband所擁有的US6,772,210 (以下簡稱’210專利)、US 6,791,971 (以下簡稱’971專利)、US 6,885,658 (以下簡稱’658專利)、US 7,995,589 (以下簡稱’589專利)、US 7,047,561 (以下簡稱’561專利)、US 7,184,427 (以下簡稱’427專利)、US 7,990,984 (以下簡稱’984專利)、US 6,934,279 (以下簡稱’279專利)等8項美國專利。
Genband創立於1999年，總部位於德州Frisco，是IP基礎架構解決方案廠商，該公司提供市場IP語音交換、應用、聯網和服務解決方案，其產品在80多個國家的600多個客戶網路中廣泛部署。
被告Metaswitch是電信系統與通信軟體解決方案供應商，主要提供通訊基礎設施、通訊軟體與會談邊界控制三個領域的相關服務。該公司也提供電話應用平台、平板電腦與智慧型手機使用之通訊應用程式以及統一訊息介面平台。其用戶超過600個無線與有線營運商，包括AT&T、BT(英國電信)、Deutsche Telekom(德國電信)等公司都是Metaswitch之用戶。
本案系爭專利與被控侵權產品如下，其中’589專利、427專利與’984專利為Genband自行研發申請之專利，其餘五項專利權皆購自北電網路(Nortel Networks)：
- ’210專利名稱「在內部網路協定環境中，以電話號碼為基礎之裝置間交換通訊之方法與裝置(Method and apparatus for exchanging communications between telephone number based devices in an internet protocol environment)」，專利技術涉及管理網路協定中，使用網路位址之通訊網路以及使用電話號碼為基礎之裝置兩種不同技術間之通訊轉換技術。被控侵權產品為Metaswitch的Perimeta Session Border Controller。
- ’971專利名稱「提供一種用以通訊以及擴充數據封包網路功能之通訊服務方法與裝置(Method and apparatus for providing a communications service, for communication and for extending packet network functionality)」，專利技術是涉及網路通訊服務中，提出通訊服務請與與產生響應之方法。被控侵權產品為Perimeta Service Broker。
- ’658專利名稱「用於IP電話協定內部工作之方法與裝置(Method and apparatus for interworking between internet protocol (IP) telephony protocols)」，屬於IP電話協定中，通話伺服器之結構與工作技術。被控侵權產品為Integrated Softswitches (包括VP6010,VP6050)與Universal Media Gateways (包括MG6010, MG6050)。
- ‘279專利與’589專利名稱「透過數據網路控制聲音通訊(Controlling voice communications over a data network)」，涉及透過數據網路，在一用以控制通話之控制系統中提供使用者介面與通話會談資訊之方法與裝置。被控侵權產品為Metasphere Telephony Application Server。
- ’561專利名稱「即時網路應用之防火牆Firewall for real-time internet applications」，專利技術為可用於VoIP等即時網路應用之防火牆技術。被控侵權產品為Perimeta Session Border Controller。
- ’427專利名稱「用以傳播來自寬頻網路之電信通訊資訊至一電信通訊系統之系統與方法(System and method for communicating telecommunication information from a broadband network to a telecommunication network)」，涉及在寬頻網路中，傳播電信資訊至另一電信網路之系統與技術。Integrated Softswitches (包括VP6010,VP6050)與Universal Media Gateways (包括MG6010, MG6050)。
- ’984專利名稱「在一寬頻網路與電信網路中傳播電信資訊之系統與方法(System and method for communicating telecommunication information between a broadband network and a telecommunication network)」，涉及在寬頻網路中與電信網路兩種系統中，交換傳播電信資訊之系統與技術。被控侵權產品為Integrated Softswitches (包括VP6010,VP6050)與Universal Media Gateways (包括MG6010, MG6050)。
Genband指控Metaswitch未經Genband同意授權，即利用其專利技術製造、使用、販售、提供銷售系爭侵權產品，已直接侵害Genband專利權。Genband請求法院核發禁制令，以排除Metaswitch之侵權行為，並要求Metaswitch需支付專利侵害損害賠償與訴訟相關費用。(1190字；表3)
