朗科科技專利訴訟地圖

新聞：（2007年12月12日中央社-福爾科技對勁永提專利權訴訟‧勁永：委請律師處理）福爾科技日前向板橋地方法院提起侵權民事訴訟，認為勁永國際 (6145) 侵犯專利權，勁永今天接獲板橋地方法院通知，勁永表示，將針對此案委請律師處理出庭應訊等法定程序。

評析：
這是一個舊新聞，也是一個與台灣專利授權公司（Non-Practicing Entities, NPE）相關新聞，本文進一步追蹤，並製作專利訴訟地圖。

新聞主角有三，其一為中國朗科科技（Netac Technology），另一為台灣福爾科技，第三為勁永國際。勁永國際是被告，就暫且不談。該訴訟案原專利權人為中國朗科科技，該公司在2001年7月9日申請名稱為「一種多功能半導體儲存裝置及用以啟動電腦主機之方法」發明專利，並於2005年8月1日核准公告，證書號為I237264。調查截至2008/12/29，朗科科技的專利統計如表一：

2006年10月31日，朗科科技與福爾科技針對I237264專利簽署合約，授權部分包括製造、販賣、使用授權等，授權期限至2008年12月01日。2007年12月12日福爾科技在板橋地方法院控告勁永國際侵權，並求償新台幣3,000萬元。在本案中，福爾科技即為典型專利授權公司，而代理之專利是土生土長的中國技術。補充說明，朗科科技在台灣共計獲得4件專利，其中僅I237264授權予福爾科技，授權公告如表二：

除本訴訟外，朗科科技先前亦在多地主張其專利權，包括中國與美國。在中國部分包括2002年對中國華旗、富光輝、星之島等十數家公司，與2004年在深圳市中級人民法院對Sony子公司提起訴訟，並對Sony要求1,000萬人民幣損害賠償。在對Sony一案中，朗科科技專利為ZL99117225.6，該專利申請於1999年11月14日，核准公告於2002年7月24日，專利名稱為「用於資料處理系統的快閃電子式外存儲方法及其裝置」。被控侵權產品為USB隨身碟。

美國訴訟部分為2006年2月13日朗科科技於東德州聯邦地方法院控告記憶體公司PNY Technologies侵犯該公司US6,829,672專利。US6,829,672專利名稱為「Electronic flash memory external storage method and device」核准於2004年12月7日，與中國ZL99117225.6同一專利家族，但並非與台灣專利I237264同一案。

最後，被告侵權當然要緊張，但不用緊張太久。新聞中福爾科技控告勁永國際專利，與朗科科技控告Sony與PNY Technologies專利技術內容差異為何？I237264專利內容為何，專利有效性為何與是否侵權否？等等問題都需委由智權專家進一步判斷。朗科科技雖然在中國積極主張其專利，但是技術層次如何可委由領域技術專家進一步評估。（本文：1008字）
