2013年11月13日Message Notification Technologies LLC (以下稱MessageTech)，於美國達拉威聯邦地方法院(United States District Court, The District of Delaware)向CISCO SYSTEMS, INC. (以下稱Cisco)提起專利侵權訴訟，指控Cisco所提供利用的訊息整合系統侵害MessageTech所擁有的US5,944,786 (以下簡稱’786專利)美國專利。
MessageTech於2013年11月，同時控告Cisco、Unify Inc.,f/k/a Siemens Enterprise Communications、AVAYA Inc.、Oracle、AT&T等通訊服務大廠專利侵權。其中用以控告Cisco侵權之’786專利名稱為「經由電話系統且不須登入電子郵件伺服器之電子郵件接收自動通知(Automatic notification of receipt of electronic mail (e-mail) via telephone system without requiring log-on to e-mail server)」，是涉及遠端伺服器接收電子郵件後，可經由電話通訊系統通知收件人之通訊技術。’786專利是發明人KEN QUINN也是原專利權人，於2013年7月5日讓渡給專利授權公司EMPIRE IP LLC，MessageTech宣稱目前由該公司擁有該專利所有權利，並據此提告。
EMPIRE IP LLC是一家智財權管理公司，專門為獨立發明人或是企業體提供活化專利資產服務。EMPIRE營運方式除了收購專利與自行提起專利訴訟外，也會出售其收購之專利權給其他專利授權公司，由其他專利授權公司進行專利訴訟。本案系爭專利即是MessageTech由EMPIRE IP LLC手中所取得之專利權，並據以提告。
MessageTech指控Cisco所提供利用的「Cisco Unity Connection」整合訊息系統產品與服務技術，皆是架構於’786專利技術之上，Cisco未經MessageTech同意，即製造、使用、進口、提供、散佈、販賣與提供販賣該些產品，已直接侵害’786專利。且Cisco提供該些侵權產品給其用戶使用，導致其用戶直接侵權行為，因此Cisco也成立誘導侵權。此外，Cisco在其US7,680,253美國專利說明書中，曾引用’786專利，表示Cisco已知道’786專利存在，卻仍進行其侵害行為，因此Cisco之行為屬於故意侵權。MessageTech請求法院核發永久禁制令，排除Cisco侵權行為，並要求Cisco支付專利侵害損害賠償與訴訟相關費用。(857字；表3)
