2013年11月5日，位於德州的專利授權公司IBV Systems, LLC（下稱IBV Systems），向東德州聯邦地方法院馬歇爾分院（Eastern District of Texas Marshall DivisionDivision）提起訴訟，控告總部位於麻州的科技公司AeroScout, Inc（下稱AeroScout），所使用的RFID定位系統，侵害其專利權。IBV Systems除要求法院禁止AeroScout的侵權行為外，並要求AeroScout負起損害賠償的責任。
原告IBV Systems成立於今年（2013年）八月，負責人是一位名為Neal Massand的專利律師，Mr.Massand目前服務於德州Ni, Wang & Associates, PLLC的智財法律事務所。被告AeroScout成立於1999年，主要提供具有Wi-Fi功能的RFID追蹤、警示及定位報告系統，去年六月AeroScout被一間醫療保健器材商Stanley Healthcare Solutions併購。
本案系爭專利為美國專利編號US 6,222,440，專利名稱為「在預設區間使用閃控訊號的定位、識別和遙測系統（Location, Identification and Telemetry System Using Strobed Signals at Predetermined Intervals）」，於2001年4月24日核發，是由Alan C. Heller所研發的專利，原專利權人是Freshloc Technologies, Inc。

A method of identifying a transmitter that has identifying information, comprising the steps of:
偵測含有可提供辨識資訊的信號發射器的方法，包括以下步驟：
transmitting portions of the identifying information from the transmitter at predetermined intervals;
在預設的時間區間，從信號發射器傳送部分可提供辨識的資訊；
receiving the transmitted portions of the identifying information;
接收部分可提供辨識的資訊；
positively identifying the transmitter after receiving a plurality of the transmitted portions of the identifying information based on the identifying information; and
當接收到大量可傳輸的可辨識資訊後，主動偵測信號發射器；
以及subsequently identifying the transmitter based on the time of arrival of subsequently received transmitted portions of the identifying information relative to the time of arrival of previously received transmitted portions of identifying information.
每一次可辨識資訊傳送到達的時間與前一次可辨識資訊傳送到達的時間有關，根據資訊傳送到達的時間，持續的偵測信號發射器。 |

除了AeroScout外，IBV Systems也以相同專利告了另外一家名為Ubisense, Inc（下稱Ubisense）的廠商。Ubisense是AeroScout的同業，提供即時定位系統的產品與服務。（802字；表2）
