2013年11月12日，營業處所位在德拉瓦州的專利授權公司Cloud Stachel LLC(下稱Cloud Satchel)，向美國德拉瓦州聯邦地院提起專利侵權告訴，控告北美營業處所位在加拿大多倫多市、提供電子書販售服務之Kobo, Inc.(其為經營日本最大電子商店街樂天市場之公司Rakuten, Inc.的子公司，下稱Kobo)，其所製造銷售的電子書閱讀器(eReader)與平板電腦產品(如Kobo Touch、Kobo Mini、Kobo Glo、Kobo Arc、Kobo Aura等)，其所免費提供給智慧型手機或平板電腦使用的電子書閱讀器App，以及其提供電子書販售服務給其電子書閱讀器產品的網站，直接與間接侵害了Cloud Stachel所擁有之兩項與電子文件存取與散佈技術有關的專利權利。
本案兩項系爭專利內容如下：
美國專利編號US 5,862,321與US 6,144,997，名稱均為「用來存取與散佈電子文件的系統與方法（System and method for accessing and distributing electronic documents）」，分別於1999年1月19日核發與2000年11月7日核發，發明人均為Michael Lamming與Michael J. Flynn，原始權利人均為Xerox Corporation，而後者為前者之連續案。Cloud Stachel主張至少前者專利之請求項1、15與19，以及後者專利之請求項1受到侵害。
Cloud Stachel在訴狀中指出，曾在2013年6月26日寄送專利侵權警告函給Kobo，說明Kobo產品與所營運的系統就系爭專利構成侵權。Cloud Satchel曾在2013年8月2日基於本案系爭專利向本案相同法院起訴，控告Sony所製造銷售的PRS系列電子書閱讀器產品與Xperia平板電腦產品構成專利侵權(Cloud Satchel LLC v. Sony Electronics Inc. et al，案號為1:13-cv-01381-UNA)，亦曾在2013年5月24日起訴，分別控告美國兩大電子書商Amazon之Kindle系列產品(Cloud Satchel LLC v. Amazon.com Inc.，案號為1:13-cv- 00941-SLR)與Barnes & Noble之Nook系列產品(Cloud Satchel LLC v. Barnes & Noble Inc.，案號為1:13-cv-00942-SLR)，就兩項系爭專利構成侵權。
Cloud Stachel在訴狀中所載的地址，至少與曾積極提起專利侵權告訴之專利授權公司UbiComm LLC (其用來起訴之US 5,603,054專利的原始權利人亦是Xerox Corporation)與Efficiency Systems, LLC 相同，且三家公司所委託進行訴訟之律師事務所(Stamoulis & Weinblatt LLC)亦是相同。根據美國專利商標局(USPTO)之公開資料，本案系爭專利是在2013年1月31日從Xerox Corporation移轉給一家地址與Cloud Stachel相同的Advanced Escreens, LLC，而後再於同年5月6日移轉給Cloud Stachel。(1057字；表2)
