2013年10月18日Alex Is The Best, LLC (以下稱AITB)於美國達拉威聯邦地方法院(United States District Court, The District of Delaware)向Amazon.Com. Inc.、Amazon Web Services,LLC (以下稱Amazon)、與Asus Computer International (以下稱Asus)等多家公司提起專利侵權訴訟，指控amazon、Asus等所製造販賣的多款電子裝置侵害AITB所擁有的US8,134,600 (以下簡稱’600專利)與US8,477,197 (以下簡稱’197專利)兩篇美國專利。
美國專利商標局資料庫顯示，AITB目前擁有四項美國專利權，其中兩項是在2011年5月取得，包括本案系爭專利’600專利以及US7,633,524專利，2012年8月取得’197專利，2013年10月取得第四項專利US7,907,172專利。此四項專利之發明人皆相同，除’197專利外，原專利權人也都是發明人之ㄧ的Frank Clemente。
AITB購得四項專利後，以600與’197專利受到侵害為由，於2013年10月在Delaware地院同時控告多家平板電腦與智慧型手機大廠；除本報導詳述之Amazon與Asus訴訟外，還包括ZTE(包括ZTE Corporation與ZTE (USA), Inc)、HTC (包括HTC Corporation與HTC America, Inc.)、LG(包括LG Electronics, Inc.、LG Electronics U.S.A., Inc和LG Electronics Mobilecomm U.S.A.,Inc)、Sony(包括Sony、Sony Mobile Communications AB、Sony Mobile Communications、Sony Electronics等) (註一)。該兩項系爭專利名稱皆為「網路直接裝置(Internet Direct Device)」，是與影像採集與傳輸相關技術，其中’197專利是’600專利之延續案，’600專利則是US7,907,172專利之延續案，US7,907,172專利則是US7,633,524專利之延續案。
AITB於訴狀中宣稱，Asus的平板電腦Nexus 7(2013)可擷取靜止或動態視頻圖像，並經由WiFi、3G或4G LTE等通信方式，將圖像傳輸至Google+等雲端網路裝置儲存之方式，乃是使用了兩項系爭專利技術。同樣的，Amazon的平板電腦Kindle Fire HD 8.9” Wi-Fi + 4G LTE，也可擷取靜止或動態視頻圖像，並以WiFi或4G LTE方式傳輸到Amazon雲端硬碟(Amazon Cloud Drive)等網路裝置，亦是使用了系爭兩項專利技術。同時，指出侵害’600專利與’197專利權利範圍第一項。AITB請求法院判決，Asus與Amazon必須支付專利侵害損害賠償與訴訟相關費用。(1074字；表3)
