2013年9月26日，註冊於美國德州的Hilltop Technology LLC (下稱Hilltop)，於美國東德州聯邦地方法院馬歇爾分院，指控總部位於台灣新竹的面板廠友達光電(AU Optronics Corporation)及其在美分公司AU Optronics Corporation America(下合稱友達)之觸控面板，侵犯其專利權，要求法院核發永久禁制令、也要求合理的權利金、損害賠償以及訴訟律師費之補償等。
本案系爭專利共1項，為美國專利編號US 7,864,503，名稱為電容式觸控面板(Capacitive type touch panel)，係於2008年4月23日申請，2011年1月4日，發明人為Yu-Huei Chang(張玉輝)，原始專利權人為Sense Pad Tech Co., Ltd(觸控科技有限公司;註冊於薩摩亞)，目前專利權人為Hilltop Technology LLC，經USPTO轉讓資訊查詢，其下僅擁有此項專利。本系爭專利系主張台灣申請專利申請案之優先權，其專利編號為TWI332169，名稱為透明觸控面板裝置，係於2007年05月11日申請，2010年10月21日核准。
本案原告Hilltop Technology LLC，經查詢其於USPTO轉讓資訊所登記之地址，該址為一提供商務法律諮詢的公司，目前不清楚Hilltop Technology LLC與該商務法律諮詢公司之間的關係，尚無法清楚的知道Hilltop Technology LLC的來歷。但是，從原告委任律師代表Winston O. Huff 可得知，他代表台灣資策會及成大在美國主張專利權，出面指控外國廠商已有將近10多件。(666字；表2)
