2013年9月6日,美國普利司通控股公司Bridgestone Americas, Inc.旗下之事業部門Bridgestone Americas Tire Operations, LLC (下稱美國普利司通),向美國德拉瓦州聯邦地院提起專利侵權告訴,控告名列全球十大汽車零件供應商之一、亦為全球領先之汽車安全系統供應商TRW Automotive Holdings Corp,及其旗下子公司TRW Automotive US LLC與TRW Automotive Inc.,以及TRW Automotive與米其林輪胎(Michelin)所合資成立的Entire Solutions LLC等共同被告(以下統稱TRW),其所製造銷售的胎壓監測系統感應器(tire pressure monitoring system sensors, TPMS sensors)產品,侵犯美國普利司通所擁有之3項與監測輪胎狀態系統相關的專利權利。
本案3項系爭發明之內容如下:
美國專利編號US 5,562,787,名稱為「監測車輛輪胎狀態的方法(Method of monitoring conditions of vehicle tires)」,於1996年10月8日核發;
美國專利編號US 6,630,885與US 7,161,476,名稱均為「電子輪胎管理系統(Electronic tire management system)」,分別於2003年10月7日與2007年1月9日核發,後者為前者在申請時的部分連續案(continuation-in-part, CIP)。
美國普利司通在2013年5月2日便曾向本案相同法院起訴,控告TPMS感應器的OEM大廠Schrader-Bridgeport International Inc.,侵害本案相同系爭專利(Bridgestone Americas Tire Operations LLC v. Schrader-Bridgeport International Inc. et al,案號為1:13-cv-00763-UNA)。
美國普利司通前身為1988年日本輪胎大廠Bridgestone Corporation收購美國輪胎公司The Firestone Tire & Rubber Company後所成立的分公司Bridgestone/Firestone, Inc.,而普利司通集團現為世界最大輪胎製造商。
2000年美國國會通過Transportation Recall Enhancement, Accountability and Documentation (TREAD) Act,強制要求新出廠的汽車需裝載TPMS,而在美國市場裝載有TPMS的汽車在2006年估算是1450萬輛,2010年攀升到6460萬輛,而預估在2016年會達到1億4680萬輛。歐盟議會亦在2009年通過相關立法,預計在2014年達到全面施行;而日本、南韓、中國、印度等亞洲國家亦將跟進立法。據估計,在歐洲與北美,2018年TPMS的市場值將會成長至2011年的3倍。(920字;表2)
