耳機掛耳固定器產品設計侵權，Innovelis控告Zeikos

2013年8月13日，一家營業處所設在美國華盛頓州、宣稱其業務焦點為透過開放商業模式將創新產品帶入消費市場的公司Innovelis, Inc.(下稱Innovelis)，向美國紐約州南區聯邦地院提起專利侵權告訴，控告依據紐約州法所設立、國際營運總部設在紐澤西州的消費電子產品周邊設備廠商Zeikos, Inc.(下稱Zeikos)，以及營運總部設在麻薩諸塞州、以販售服飾與家居用品為主的折扣零售商TJX Companies, Inc.(下稱TJX)，還有在提出訴狀之時點Innovelis尚未能提其具體資訊的其他被告(在訴狀中被列為不知名被告，John Does 1-10)等，侵害Innovelis所擁有的設計專利權利。

Innovelis在其訴狀中指出，構成侵權的產品是Zeikos以iHip為品牌商標所推出的耳機掛耳固定器產品iHip Gadgets Ear Hook(然而這項產品已無法在iHip網站http://www.ihip.com/上搜尋到)，其具備可以接在耳塞式耳機、讓耳機可以掛在人耳上、而在使用者從事運動時固定耳機位置的功能。Innovelis在其訴狀中並未言明另一被告TJX與被控侵權產品間的關係，而只是概括地指陳，共同被告製造、進口、為販賣之要約、使用與販賣該產品之行為，就系爭專利構成直接與間接侵權。Innovelis在其網站上有展示一項類似產品BudFits (http://www.innovelis.com/budfits.html)，其功能是固定iPod或iPhone之耳塞式耳機不會在運動中滑落。

本案系爭設計專利為美國專利編號US D597,069，名稱為「耳機固定位置裝置(Headphone positioning device)」，於2009年7月28日核發，發明人為Innovelis之創辦人與前任執行長Eric John Wengreen (任職期間2007年7月至2012年8月)。Wengreen現職為Knobbe Martens Olson & Bear LLP的專利律師，擁有史丹福大學(Stanford University)的工程碩士學位，以及該校法學院的法律學位(J.D.)，曾任職於醫療器材大廠Medtronic, Inc.，並列名為多項發明專利(例如US 8,055,356、US 8,276,487、US 8,428,289等)之發明人或共同發明人。(1021字；表2)
