2013年8月12日，一家營業處所設在美國紐約州、以SmartfishTechnnologies LLC為商號、開發出知名人體工學電腦鍵盤(SmartfishErgoMotion Keyboard)與滑鼠(SmartfishErgoMotion Mouse)產品的公司Ergowerx International LLC(下稱Smartfish)，向美國紐約州南區聯邦地院起訴，控告日商麥克賽爾公司(Hitachi Maxell, Ltd)的美國分公司Maxell Corporation of America(下稱Maxell)，違反其與Smartfish所簽訂的經銷契約(breach of contract)、以詐欺手段誘使Smartfish簽約(fraud in the inducement)而讓Smartfish蒙受損失、並因為違反契約中對經銷通路之限制而構成侵害Smartfish所擁有之1項發明專利與4項設計專利權利(patent infringement)。
Smartfish在其訴狀中指出，其與Maxell在2009年12月22日簽訂經銷契約，依據契約Maxell會從Smartfish購入電腦鍵盤與滑鼠產品；而Maxell亦公開宣布其與Smartfish的合作夥伴關係，並會經銷Smartfish的人體工學鍵盤與滑鼠產品。
Smartfish指控Maxell多項違反雙方約定的行為。首先，Smartfish主張，Maxell對其提出不合理之要求做為履約條件，例如要求Smartfish購買Maxell的品牌電池、向Smartfish要求生產不常見顏色之產品導致產品可銷性受到限制、要求Smartfish重新包裝產品卻未依約支付相關成本等。其次，Smartfish指出經銷契約中有保留專屬給Smartfish的銷售通路，包括Amazon網站、電子零售通路(e-tailers)、北美與拉丁美洲以外地區等，而Maxell並未獲授權透過這些通路流通產品，但Maxell卻違反前述約定，如設立其線上商店shopmaxell.com等。再者，Smartfish指控Maxell並未善盡其以商業上可行之努力推廣Smartfish產品的契約義務，亦未履行契約所訂最低採購金額的採購義務。
Smartfish在其訴狀中指陳，因為Maxell之行為，導致Smartfish必須裁員並關閉其獨立銷售之通路(例如smartfish.com)，而Maxell之違約行為讓Smartfish之公司價值下滑，無法獲得其依據契約應得之利潤，進而產生影響公司營運之現金留缺口。
除前述控訴外，Smartfish在其訴狀中亦指控，Maxell侵害Smartfish之商標權利(trademark infringement)，誤用Smartfish表示其商品與服務之表徵、而就產品來源做出虛偽不實或引人錯誤之表示或表徵、進而違反美國蘭哈姆法(Lanham Act)之規定(15 U.S.C.§ 1125(a))，以及Maxell之行為構成不當得利(unjust enrichment)等。
本案5項系爭專利內容如下：
美國發明專利編號US 8,130,197，名稱為「浮動式鍵盤(Floating keyboard)」，於2012年3月6日核發；
美國設計專利編號US D615,976，名稱為「鍵盤(Keyboard)」，於2010年5月18日核發；
美國設計專利編號US D616,442，名稱為「遊戲搖桿控制器(Game controller)」，於2010年5月25日核發；
美國設計專利編號USD616,444與D645,863，名稱均為「滑鼠(Mouse)」，分別於2010年5月25日與2011年9月27日核發。(1161字；表3)
