2013年7月12日，總部設立於美國紐約的Research Frontiers Incorporated(“Research Frontiers”)，於美國德拉瓦州地方法院，指控總部位於台灣新竹的E Ink Holdings Inc.(元太科技)以及其在美子公司E Ink Corporation(下合稱元太)、總部位於美國華盛頓的Amazon.com Inc.(“Amazon”)、日商Sony Corporation及其在美子公司Sony Electronics Inc.(下合稱”Sony”)以及總部位於美國紐約之的Barnes & Noble, Inc.與Barnesandnoble.com LLC(下合稱”B&N”)之電子紙技術相關顯示產品，侵犯其專利權，要求法院核發永久禁制令、合理的權利金、損害賠償以及訴訟律師費之補償等。
本案系爭專利共2項，專利權人皆為Research Frontiers Incorporated，詳細資料如下:
- 美國專利編號US 6,606,185，名稱為由混合金屬氧化物組成的熱反射顆粒液態懸浮物之SPD薄膜與光閥以及該些顆粒的製造方法(SPD films and light valves comprising liquid suspensions of heat-reflective particles of mixed metal oxides and methods of making such particles)，係於2001年6月12日申請，2003年8月12日核發。
- 美國專利編號US5,463,491，名稱為包含有液態懸浮物封包之使用薄膜之光閥之製造方法(Light valve employing a film comprising an encapsulated liquid suspension, and method of making such film)，係於1992年11月6日申請，1995年10月31日核發。
Research Frontiers於訴狀中指出，Amazon、Sony與B&N之電子紙相關顯示產品，皆包含有元太科技所提供光學技術，可以看出Research Frontiers主要是針對元太，並將元太的客戶Amazon、Sony與B&N列為被告，主要原因除了元太可能本身並無成品在美國販售外，更有逼迫元太必須為其客戶出面釐清技術內容之意味。
本案原告Research Frontiers，總部位於美國紐約，成立於1965年，主要致力於光學控制(SPD; Smart light-control)技術，在電子光學領域，擁有超過290項專利，並有40餘間公司與其簽署有專利授權協議。(780字；表2)
