2013年6月28日，一家依據德拉瓦州州法所成立、營業處所亦設於該州的公司Efficiency Systems,LLC(下稱ES)，向美國德拉瓦州聯邦地院提起4起專利侵權告訴，控告思科(Cisco Systems Inc.)、戴爾(Dell Inc.)、IBM(International Business Machines Corporation)與Oracle (Oracle Corporation和Oracle America Inc.)等，其所製造販售之伺服器(如思科UCS C系列機架式伺服器、戴爾PowerEdge伺服器、Oracle Sun X86 伺服器等)、刀鋒伺服器(如思科UCS B系列刀鋒伺服器、IBM BladeCenter HS23 與 HS23E 刀鋒伺服器等)、刀鋒伺服器機箱(如思科UCS 5100 系列刀鋒伺服器機箱等)等電腦系統產品，直接或間接侵害了ES所擁有、就電腦系統進行電力管理之方法與裝置專利。
本案系爭專利為美國專利編號US 6,986,069，名稱為「用於進行電腦系統靜態與動態電力管理之方法與裝置(Methods and apparatus for static and dynamic power management of computer systems)」，於2006年1月10日核發，發明人為Richard R.Oehler、Carl Zeitler, Jr. 與Richard O. Simpson，原始權利人則為Newisys, Inc.。Newisys, Inc.在2004年被Sanmina-SCI Corporation(於2012年更名為Sanmina Corporation)併購。依據美國專利商標局(USPTO)所公告資料，系爭專利於2008年移轉給Sanmina-SCI Corporation，而Sanmina Corporation則在2013年6月4日移轉給一家名為Memory Integrity, LLC的公司，並於2013年6月11日移轉給本案原告ES(Memory Integrity, LLC與ES在USPTO公告資料中所揭示地址完全相同)。
以ES控告思科之訴狀為例，ES在其中陳述，在2013年6月12日ES寄送專利侵權警告函給被告思科，通知其製造販售具備電力管理功能之刀鋒伺服器等電腦系統產品的行為，是至少侵害了系爭專利獨立請求項1所揭露之裝置發明。
本案同日，另一家名為UbiComm, LLC之公司，亦以包括戴爾在內的多家公司做為被告，於本案相同法院提起多起專利侵權告訴，而這家公司在其訴狀中所記載的德拉瓦州地址，與本案原告Efficiency Systems, LLC相同，且亦是委託相同之律師事務所(Stamoulis & Weinblatt LLC)來進行訴訟。從先前USPTO的權利移轉資料可以看出，ES透過一家設立於相同地址的公司、輾轉從美國EMS大廠Sanmina Corporation 手上取得系爭專利權利，並在獲得權利後次日寄發侵權警告函，然後在約半個月後便提起專利侵權告訴，這樣行使專利權利來獲利的手法，值得密切追蹤觀察。(1047字；表3)
