2013年6月18日，一家總部位於德州的專利授權公司Bluebonnet Telecommunications, LLC.（下稱Bluebonnet），在東德州聯邦地方法院馬歇爾分部（Eastern District of Texas Marshall Division）提起專利訴訟，控告總部位於台灣的HTC America Inc.（下稱HTC）所提供的產品與服務，侵犯其來電轉接（Call Forwarding）專利。Bluebonnet除要求HTC停止侵權行為外，並要求HTC賠償其損失。
本案系爭專利為美國專利編號US 5,485,511，專利名稱為「電話通訊功能設定的方法與裝置（Method and Apparatus for Determining the Telephony Features Assigned to a Telephone）」，於1996年1月16日核發，是由David Iglehart, Elie A. Jreij, Andrzej Koscinski, Leland Lester及Robert D. Whittington所研發並申請的專利。此專利的應用是，使用者透過電話（或行動裝置）進行一系列的功能設定後，這些設定的指令會自動傳輸到電信業者所提供的交換主機（Central Switch）進行處理；使用者不需再要求電信業服務人員進行一系列的人工設定。

本案系爭專利US 5,485,511包括13個技術範圍（Claims），原專利權人是Siemens Rolm Communications Inc.。一如預測，訴狀中Bluebonnet並未詳細指明HTC的侵權範圍，只約略的提到HTC至少侵害本案系爭專利的一個技術範圍。至於侵權產品方面，訴狀直接載明至少有HTC One X等產品。另外，本案系爭專利自核准後已多次轉手，Bluebonnet於今年1月18日才取得專利權。
Bluebonnet指控HTC所提供的產品與服務，侵害其來電轉接技術的專利權。訴狀中Bluebonnet指稱：（1）HTC指導其顧客使用侵權產品的誘導行為；（2）兜售侵權智慧型手機的行為；及（3）製造侵權智慧型手機的行為，侵害Bluebonnet專利US 5,485,511。另外，Bluebonnet宣稱，HTC在發行產品前，針對產品是否涉及侵權的評估形同虛設；後續的侵權行為顯示，HTC對Bluebonnet的專利視而不見。
在對HTC興訟的同一天，Bluebonnet一併控告其他12家國際通訊大廠。訴狀的內容幾乎大同小異，都是針對本案系爭專利US 5,485,511而來。這12家大廠有：Apple、Dell、Google、Hewlett-Packard、LG、Motorola、Nokia、Pantech Wireless、Research In Motion（RIM）、Samsung、Sharp及Sony。其中，Apple被控侵權的產品為iPhone 4S及iPhone 5。
本案另外一個有趣的觀察點是訴訟法院。在專利侵權訴訟中，東德州聯邦地方法院向來被認為是專利流氓的天堂（或稱偏愛的法院），原因大致如下：（1）審判快速；（2）陪審團傾向專利有效認定；（3）賠償金額相對較高。據統計，除2011年外，歷年來東德州都是美國94個聯邦地方法院中專利訴訟提起案件最多的法院。另外，許多專利授權公司為了地利之便，更是偏愛將其總部設在東德州，這種情形，在本案興訟的馬歇爾地區尤其普遍。(950字；表2)
