數位電視ATSC標準專利訴訟，MPEG LA四位專利權人共同控告ViewSonic等公司

2013年6月4日，總部設立於美國伊利諾州的Zenith Electronics LLC (“Zenith”)、日商Panasonic Corporation (“Panasonic”)、總部設立於美國紐約的U.S. Philips Corporation (“Philips”)，以及位於美國紐約的哥倫比亞大學基金會(The Trustees of Columbia University in the City of New York; ”Columbia”) ，於美國佛羅里達州南區地方法院，指控日商ViewSonic Corporation使用ATSC標準系統之數位電視，未經專利授權使用其專利權，要求法院核發禁制令、損害賠償以及訴訟律師費之補償等。

本案系爭專利共5項，分別為Zenith所擁有的US 5,802,107以及US 5,629,958、Panasonic所擁有的US Re 42,643、Philips所擁有的US 5,684,541，以及Columbia所擁有的US 8,115,873。

本案係關於數位電視標準，為1982年進階電視標準委員會( Advanced Television Systems Committee; ATSC)所訂定，使用該標準的國家有美國、加拿大、墨西哥、南韓和宏都拉斯等。而ATSC相關技術的專利相關授權事宜，由總部設立於美國科羅拉多州的MPEG LA, LLC (“MPEG LA”)所管理，該專利池(patent pool)目前仍為有效的各國專利共有220篇，專利權人除了本案四個原告外，亦有JVC KENWOOD Corporation、LG Electronics Inc.、Mitsubishi Electric Corporation以及Samsung Electronics Co., Ltd.。而與MPEG LA簽訂有ATSC授權協議的公司共有128家，幾乎所有常見的品牌廠商與製造商都有簽訂ATSC技術授權協議，為數位電視必要專利技術之一，其中包括目前市面上的高畫質ATSC數位電視接收器。

此外，本案四個原告，亦於2013年6月4日，於美國佛羅里達州南區地方法院控告另外2家公司Craig Electronics Inc.及Curtis International Ltd.，該案號分別為:9:13-cv-80567與9:13-cv-80568。(610字；表2)
