2013年5月21日，設於美國德州的專利授權公司Penovia LLC(原告)以專利侵害為由，對三星電子美國分公司(Samsung Electronics America, Inc.，被告)提起專利侵權之訴，全案將由德州東區地方法院負責審理。
根據其訴狀，原告指控三星電子侵害其所擁有的專利US5,822,221(系爭專利)，該專利於2010年11月8日時因原持有人，也就是系爭專利的發明人Frank S. Groenteman無法支付維持費用而逾期，然而三星電子在其仍有效時便侵害系爭專利，被指控侵權的產品為辦公室機器監視裝置，包括含有無線監控(如存墨量等)裝置的印表機，如三星電子所產製的ML-2525W無線印表機(系爭產品)。據其訴狀指出，三星電子侵害系爭專利至少始於本案提起訴訟的六年前(即2007年)。

就在對三星電子提告的當日，Penovia LLC也同時大動作對數家印表機大廠以系爭專利提起專利侵權訴訟，被控告者包括愛普生(Epson America, Inc.)、全錄(Xerox Corporation)、 理光(Ricoh USA, Inc.)、兄弟國際(Brother International Corporation)、佳能(Canon U.S.A., Inc.)、利盟(Lexmark International, Inc.)、斑馬技術(Zebra Technologies Corporation)及日商OKI Data Americas, Inc.等，共九家多功能印表機廠商。
Penovia LLC為專利授權公司，本身並不實施專利，系爭專利也是向發明者Frank S. Groenteman購買而得。該公司成立於2012年底，負責人為Gautham Bodepudi，他和Lillian Woung、Sanjay Pant等三人共同經營專利授權事業，與Penovia在相同地址的公司，還有Novelpoint Tracking LLC、Novelpoint Security LLC、Novelpoint Learning、Novelpoint Holdings、Sanjay Pant PLLC及Summit IP LLC等空殼公司，皆由這三人分別掛名執掌。(650字；表2)
