2012年6月18日，一家設立於美國賓夕法尼亞州、前身為FutureVision of America Corp.之FutureVision.com, LLC公司(下稱FutureVision)，向美國德州東區聯邦地院提起專利侵權告訴，控告美國4家有線電視系統業者Time Warner Cable (Time Warner Cable, Inc.與Time Warner Cable, LLC，2012年用戶數排名第2，後來FutureVision撤銷對後者之告訴)、SuddenLink (Cequel Communications, LLC，2012年用戶數排名第9)、Comcast (Comcast of Houston, LLC與Comcast Cable Communications, LLC，2012年用戶數排名第1)以及Charter(Charter Communications, LLC，2012年用戶數排名第6)，其營運行銷提供互動服務之有線電視系統，直接與間接侵犯了FutureVision所擁有之互動多媒體系統專利權利。
前述訴訟案件在2013年4月22日被德州東區聯邦地院法官裁定應移送管轄至德拉瓦州聯邦地院，並在2013年5月16日完成移送而成為本案。
FutureVision在訴狀中指出，被控侵權之系統中至少包括以下軟硬體產品：Motorola與Cisco/Scientific Atlanta機上盒(set top box)、I-Guide軟體、Motorola NC-1500網路控制器(Network Controller)、頻帶外調變器(out-of-band modulators)、回傳解調器(return path demodulators)等。
本案系爭專利為美國專利編號US 5,877,755，名稱為「互動寬頻多媒體系統(Interactive broadband multimedia system)」，於1999年3月2日核發，發明人為Paul Hellhake。
根據FutureVision訴狀所描述，其前身FutureVision of America Corp.成立於1992年4月，當時專為Bell Atlantic Corporation之電信公司(其在2000年更名為Verizon Communications Inc.)提供「撥號音視訊」(video dial tone)服務的商機，而投入發展成為、在Bell Atlantic Corporation於紐澤西州Dover區域所建置網路上的主要「視訊資訊提供者」(video information provider)，並研發出相關技術。(715字；表2)
