2013年5月9日，一家設立於斯洛伐克共和國(the Slovak Republic)、機構組織型態為有限合夥(limited partnership)之企業Ithaca Ventures k.s.及獲得其專利技術美國地區專屬授權之美國公司Ithaca Development, LLC(以下統稱Ithaca)，向美國德拉瓦州聯邦地院提起專利侵權告訴，控告日本遊戲大廠Nintendo Co., Ltd.及其美國分公司Nintendo of America Inc.(以下統稱任天堂)，其所製造販售的任天堂Wii平衡板(Wii Balance Board)，侵犯Ithaca所擁有之有關偵測使用者身體運動之裝置與方法專利權利。
本案系爭專利為美國專利編號US 6,624,802，名稱為「用來偵測使用者特定運動狀態的方法與裝置(Method and device for detecting specific states of movement of a user)」，於2003年9月23日核發，發明人為Maximilian Klein與Peter Lutz，其專利家族包括歐洲專利公開號EP0966724(公告日為2001年11月21日)。
Ithaca在其訴狀中指出，在1999年5月Ithaca Ventures k.s.曾聯絡任天堂的代表，尋求將本案系爭專利相關技術納入任天堂遊戲機產品之可能性，並告知當時相關技術正在申請專利，而任天堂的回應則是，其已檢視過該技術但並無興趣將之納入其遊戲系統。此外，Ithaca亦指出，任天堂所擁有之至少一項專利(美國專利編號US 8,100,770，於2012年1月24日核發)，在其申請過程中有引用本案系爭專利做為先前技術文獻。依據上述舉證，Ithaca主張任天堂在2007年推出Wii平衡板產品時便已知悉本案系爭專利的存在，所以其所構成之專利侵權行為均為惡意(willful)。
本案訴狀中提及，系爭專利發明人曾將其發明應用於一款名為Cybersurfer的遊戲裝置上，不過其並未提供任何進一步的相關資訊。(1050字；表2)
