資料探勘客戶關係管理軟體(CRM)訴訟 MasterMine Software控告Microsoft

2013年4月25日，總部設立於美國明尼蘇達州的MasterMine Software, Inc. (下稱MasterMine)於明尼蘇達州地方法院，指控於總部位於華盛頓州，並於明尼蘇達州設有辦公室的微軟(Microsoft Corporation)，下稱Microsoft之Office、Excel與Microsoft Dynamics CRM(客戶關係管理軟體，提供企業用於建立客戶、維持客戶關係、管理訂單、產品銷售及報表產出等功能)相關軟體應用方法，侵害其專利權，要求核發永久禁制令及請求損害賠償。

本案系爭專利為美國專利編號US 7,945,850及US 8,429,518，名稱皆為資料挖掘及分析(Data mining and reporting)，兩案為同一臨時申請案(2000年1月7號提出，申請號60/175,025)的延伸案，分別於2011年5月17日及2013年4月23獲證，專利權人皆為MasterMine Software, Inc.。

Abstract	摘要
An integrated system is described that allows a user to easily mine and report data maintained by a customer relationship management (CRM) application. In general, the system automates the process of creating electronic reports, such as an electronic worksheet, in a format that can be directly manipulated and viewed from spreadsheet application. In one embodiment, the report is automatically generated to include a pivot table for displaying the data. The system includes a database adapted to store the CRM data. First and second reporting modules execute within the CRM software application and the worksheet software application, respectively. The reporting modules cooperate in order to integrate CRM application and spreadsheet application, thereby automating the process of generating a worksheet based on the CRM database.	一種整合系統，提供使用者容易將資料挖掘和分析來維護客戶關係管理(CRM)之應用程式。一般而言，系統會自動建立電子報表，該電子報表可直接由電子試算表中檢視及產生。在一個實施例中，該報表是以樞紐分析的方式自動產生，並可供檢視。該系統包括一個資料庫，用以儲存CRM資料；第一分析模組用以執行CRM應用程式，第二分析模組用以執行試算表應用程式；透過該第一及第二分析模組，整合CRM應用程式和試算表應用程式，並於CRM資料庫中擷取資料，自動產生一個電子報表。

MasterMine Software, Inc
創立於1999年，總部位於美國明尼蘇達州，員工不到10 人，擁有三種軟體產品，著重於客戶關係管理(CRM)相關軟體的研發與銷售。

Microsoft Corporation
創立於1975年，總部位於美國華盛頓州，為大家熟悉的電腦軟體巨人，許多科技大廠皆與其簽訂軟體方面的專利授權協議。

本案可視為小蝦米與大鯨魚的戰爭，對於MasterMine而言，對軟體巨人Microsoft發起專利侵權訴訟，於策略上，除了捍衛本身的專利權外，更可以提高知名度與軟體產品的能見度，也可以博得媒體版面。但可預見的是，Microsoft應該在不久的將來會有所反擊。(610字；表2)
