2013年4月5日，美國德拉瓦州的Mobile Transformation LLC(原告)對在德拉瓦州設立、在紐約營業的A&E Television Networks LLC(A&E電視網，被告)提起專利侵權訴訟，控告A&E電視網侵害其被專屬授權的US 6,351,736(系爭專利)，據以請求損害賠償及禁制令，由德拉瓦州地方法院管轄。
本案系爭專利於2002年2月26日獲得核准，名為「和播放數據一起展示廣告之系統及方法」，該法描述的是同時播放兩種形式的數據的方式，至少其中一種為廣告。據原告訴狀指出，A&E電視網的網站http://www.aetv.com(系爭網站)使用flash player嵌入式播放器，在播放一個含有前置式(pre-roll)影片廣告的廣告數據之後，播放互動電玩遊戲，侵害系爭專利。
