生物特徵辨識整合系統侵權 ImageWare控告M2SYS

原告IMAGEWARE SYSTEMS, INC.(以下稱ImageWare)總部位於加州聖地牙哥(San Diego, California)，該公司主力產品與技術，為”生物性特徵整合平台”(biometric fusion platform)，該公司技術將人體各種可資區別的生物特徵，包括：指紋、掌靜脈、指靜脈、臉部特徵，虹膜辨識等整合成一使用者介面，以協助需要從事個資辨識的機關或個人使用，其適用客群(產業)包括有：政府機關、邊境管制系統、醫療保險、金融服務、以及行動裝置上的商業應用軟體等。據ImageWare所稱，該公司標竿產品”IWS? Biometric Engine”為世界第一個被賦予專利的生物特徵辨識系統整合平台，可利用上述的生物特徵搜尋或辨識特定人物之身分。

被告M2SYS TECHNOLOGY, LLC(以下稱M2SYS)來自美國佛羅里達州，開發生物特徵比對軟體系統(client/server biometric software system)，提供顧客包括指紋、指靜脈、掌靜脈、虹膜辨識等混合式生物特徵辨識(Hybrid Biometrics)服務，該公司主力產品服務”Hybrid Biometric Platform?”宣稱可整合前述四項生物特徵之搜尋引擎於一使用者平台，達到最佳的辨識效果。

原告訴狀所列另一被告名稱以”DOES 1 through 10”代表，據英美法訴訟慣例推測，應為預先將未知名的被告同列本案中的方法(義同John Doe Action)，避免在稍後的審前程序中(如發現程序)才浮現之其他被告以消滅時效(statute limitations)為由提出抗辯。

除直接侵權之指控外，ImageWare另指M2SYS以輔助侵權(contributory infringement, under 35 U.S.C. § 271(c))或誘使侵權(inducing infringement, under 35 U.S.C. § 271(b))的方式，與其商業上的所謂軟體集成夥伴(software integrator partners)，包括Cisco、Kodak等數十家知名公司，以軟硬體相互輔助的方式侵害系爭7,298,873專利，以達到生物特徵匹配之效果暨商業目的。

綜上所述，ImageWare主張M2SYS以直接、誘使，或輔助侵權等態樣持續侵害系爭專利。除要求法院作出侵權認定判決之外，ImageWare請求法院核發永久禁制令以嚇阻被告未來持續的侵害，並因被告故意之行徑准予三倍的故意侵權損害賠償金(treble damages under 35 U.S.C. § 284)以及依35 U.S.C. § 285 之規定認定該案為特殊案件(exceptional case) 准予訴訟律師費之賠償。(822字，表2)
