2013年3月12日，Packet Intelligence, LLC(以下稱Packet Intelligence)對 Huawei Technologies Co., Ltd.以及 Huawei Technologies USA Inc.(以下統稱Huawei)提出關於網通專利侵權之訴，目前該案繫訟於美國德州東區聯邦地方法院(Texas Eastern District Court)。

Packet Intelligence位於德州，經查並無實質生產商品，可能為一家以專利授權為主的公司。

Huawei Technologies公司登記於德州，中國大陸手機廠商華為公司，1987年成立於大陸深圳，初期以銷售代理用戶交換機(Private Branch Exchange, PBX)為主，產品功能為處理企業或機關內部電話的交換，1990年開始自主研發。目前生產商品項目包括手機、平板電腦、行動網卡等。

本案原告Packet Intelligence提出之系爭專利共有七項(整理見表一)，以網路數據技術為主。Packet Intelligence指出，Huawei以多項網通產品侵害系爭專利，包括各種網路閘道器(gateways)，路由器(routers)，伺服器(servers)等等。

原告Packet Intelligence除請求法院宣告Huawei侵害其所主張之各項專利，永久地排除被告系爭產品之侵害，並請求法院依情節准予三倍的故意侵權損害賠償金(treble damages under 35 U.S.C. § 284)以及依35 U.S.C. § 285 之規定認定該案為特殊案件(exceptional case) 准予訴訟律師費之賠償。(字711，圖1，表2)
