智慧型汽車侵權訴訟，Acacia 子公司American Vehicular Sciences控告歐日韓汽車大廠

一家註冊於美國德州，名為American Vehicular Sciences LLC(以下簡稱為「AVS公司」)的責任有限公司，在2013年3月8日這一天，分別用不同的專利一口氣向美國東德州地方法院(U.S. Delaware District Court)提起六件專利侵權訴訟案。而事實上，從2012年6月開始AVS公司已向各歐日韓汽車大廠提起共計25件訴訟案，指稱被告所生產、銷售、使用的多項產品，分別侵害其所獲准的多項專利。

本案的原告American Vehicular Sciences LLC公司，是Acacia Research Group LLC的子公司。Acacia Research Group LLC是去年NPE列表中排名前十，頗有規模的非專利實施事業體(non-practisingentities,NPE)又稱專利蟑螂(patent troll)。哥倫比亞大學商學院教授雷蒙德菲什曼(Raymond Fishman)，更曾經針對Acacia撰寫一篇專稿「The Troll Toll」，抨擊Acacia等專利蟑螂等濫起訴訟的行為，是扼殺創新的行為。

從AVS公司是Acacia Research Group LLC的子母關係看來，AVS公司此次的訴訟，應該是不脫離Patent Troll的本質。

AVS公司分別以不一樣的專利群組，指控汽車公司的汽車產品上不一樣的技術特徵侵害其專利：

在專利侵權案6:13-cv-00226，AVS公司係基於6,738,697、 7,630,802、7,650,210、8,036,788這四件專利，主張包括有類似AcuraLink的車輛診斷系統，以及其他類似的監測，報告和 /或控制系統的汽車產品侵害這四件專利。其中分別為：

• 6,738,697的獲准日期為2004年5月18日，其名稱為「Telematics system for vehicle diagnostics」(遠距通訊系統的車輛診斷)；
• 7,630,802的獲准日期為2009年12月8日，其名稱為「Information management and monitoring system and method」(信息管理和監測系統和方法)；
• 7,650,210的獲准日期為2010年1月19日，其名稱為「Remote vehicle diagnostic management」(遠程車輛診斷管理)；
• 8,036,788的獲准日期為2011年10月11日，其名稱為「Vehicle diagnostic or prognostic message transmission systems and methods」(車輛的診斷或預後消息傳輸的系統和方法)；

在專利侵權案6:13-cv-00227，AVS公司係基於7,413,048、7,976,060、8,235,416這三件專利，主張Honda-品牌汽車及Acura-品牌汽車侵害這三件專利。其中分別為：

• 7,413,048的獲准日期為2008年8月19日，其名稱為「WeightMeasuringSystemsAndMethodsForVehicles」(重量測量車輛的系統和方法)；
• 7,976,060的獲准日期為2011年7月12日，其名稱為「Seat Load Or Displacement Measuring System For Occupant Restraint System Control」(用於乘員約束系統控制的座椅載荷或位移測量系統)；
• 8,235,416的獲准日期為2012年8月7日，其名稱為「Arrangement for sensing weight of an occupying item in a vehicular seat」(用於感測車輛用座椅中乘坐物之重量的設置)

而在專利侵權案6:13-cv-00228，AVS公司係基於8,041,483這件專利，主張包括有CollisionMitigation Braking System的Acura-品牌的汽車侵害這一件專利。其中8,041,483的獲准日期為2011年10月18日，其名稱為「Exterior airbag deployment techniques」(外部安全氣囊佈設技術)。

原告AVS公司主張被告在知悉侵權情事之後，仍持續其侵權行為，故被告的侵權行為，應成立為故意侵權（willful infringement）。此外並請求法院頒發永久禁制令(permanent injunction)，以禁止被告的後續侵害行為。

目前，該些訴訟案件已進入美國東德州地方法院審理之中。應該會由同一位法官合一審理。(1180字；表1)
