2013年02月21日，Hawk Technology Systems, LLC (以下簡稱Hawk公司)向美國佛羅里達州南區地方法院(U.S. Florida Southern District Cour)提起專利侵權訴訟(案號為1:2013cv20632)，主張Vicon Industries, Inc. (以下簡稱Vicon公司)侵害其一件專利權。
本案的原告Hawk公司是一家註冊於美國佛羅里達州公司，總部位於佛羅里達州的邁阿密，公司創辦人為Barry H. Schwab(以下簡稱Schwab)。Schwab同時也是Hawk公司內多件專利，包括本訴訟案系爭專利的發明人，他擁有麻省理工學院(MIT)的學士學位、布朗大學（Brown University）碩士學位，並已完成在伊利諾伊大學的博士後工作。
依據其公司網站可知，Hawk公司致力於發展數位視訊影像空間技術並積極進行技術授權。Hawk公司並在網頁上稱，目前提供視頻監控相關專利的授權。
而在網頁上，Hawk公司表列出其所擁有的八項專利，其專利獲准涵蓋：美國、加拿大、德國、歐洲、英國、荷蘭、法國等等。看得出來Hawk公司是一家非常積極於運用專利來營利的公司。
本案的被告Vicon公司註冊於美國紐約，是一家「安全解決方案的業界領先供應商」，產品包括ViconNet視訊管理系統的開放式安全監控管理平台，該平台具有「事件管理」的功能，可結合訪問控制、車牌識別和周邊檢測軟件來使用。
原告Hawk公司在訴狀中主張受到侵害的專利，為2012年6月12日核發之美國專利編號RE43,462專利(以下簡稱系爭專利)，其名稱為「Video monitoring and conferencing system（視頻監控和會議系統）」，這件專利共有15項專利範圍（包含3個獨立項），其發明人除了Hawk公司創辦人Barry H. Schwab之外，還有一位KinyaWashino。本案系爭專利的是US 5,265, 410的「再發證專利」(Reissue Patent)，兩者的專利範圍獨立項，實質上相同。
Hawk公司在訴狀中主張被告Vicon公司的「安全系統」(security systems)產品侵害其專利，雖然未明確指出為何項產品，但相信應該是前述的ViconNet視訊管理系統。(900字；表2)
