2013年2月8日，設於美國加州Tela Innovations, Inc. (“Tela公司”) 在美國國際貿易委員會（U.S. International Trade Commission, USITC ）對HTC、LG、Motorola、Nokia及Pantech（下稱被告公司）等五家手機品牌大廠提起337條款調查請求，指控被告公司的以手機為主的行動通訊產品侵害了其所自行生產且持有的七項IC專利，為不公平貿易行為。同一時間，Tela公司亦在德拉瓦州聯邦地方法院對相同被告公司提起平行之專利侵權訴訟（parallel actions）。
Tela公司於對HTC的訴狀中指出，HTC於美國境內未經授權而進口、製造及/或販售的手機等行動通訊裝置（特別是HTC One X），侵害其所擁有的下列七項與IC設計與應用有關之美國專利，從而請求法院發放禁制令並命被告給付損害賠償金：

原告所主張的專利主要是與IC設計及實體實施這些設計有關，而且獲證日期都相當新，是Tela所自行生產且持有的七項IC專利。 ‘049 專利與IC、方法及資料儲存裝置有關，每一者包含了在相鄰定位邏輯閘電極功能的通道內的導電邏輯閘階層特徵(conductive gate level features within adjacently positioned gate electrode feature channels)； ‘044 專利與半導體裝置的佈局有關； ‘550 專利與半導體裝置、用於半導體裝置佈局之具備程式指示之電腦可讀媒介、及依創造半導體裝置佈局的方法有關； ‘547 專利與一半導體裝置的限制性佈局區域有關； ‘428 專利與製造IC的方法與佈局有關； ‘552 專利則與IC、方法和佈局有關；‘689 專利則與IC及其佈局有關。在337調查的請求中，原告特別指出 HTC One X、LG Spectrum 2、Motorola Atrix HD、Nokia Lumia 920及 Pantech Flex 等產品侵害了上述專利。
Tela成立於2005年，是一家主要為微影驅動限制（lithography-driven constraints）先進IC製程創造設計解決方案的大型專利授權公司，獲得不少創投公司資金援助，包括：Intel Capital、Cadence Design Systems Inc.、KT Venture Group LLC (是KLA-Tencor Corp.創投夥伴) 及Qualcomm Inc.。至今該公司也以泰拉創新股份有限公司的名義在台灣至少取得了TW201214670、TW201104480、TW201020836、 TW200950064、 TW200945441、TW200943480、TW200924163、TW200900980、TW200805647等九號專利。
根據美國ITC 337調查，原告提起請求後有30天的時間決定是否正式開啟調查，倘調查結果有違反337情事，被告公司即不得進口被認定侵權之產品進入美國境內。因系爭專利相同，所以在ITC的調查期間，被告依法有權利請求在德拉瓦州的平行訴訟暫停，以等待ITC的調查結果。(1200字；表1)
