數位電視服務之爭思科反控OpenTV

2013年1月18日,網路設備商思科(Cisco Systems, Inc.)及其3家子公司CiscoTechnology, Inc.、NDS America, Inc.(於2012年被思科所併購之影像軟體和資訊安全解決方案供應商)和Scientific Atlanta LLC(於2005年被思科所併購之美國大型有線電視視訊轉換器生產商),向美國加州北區聯邦地院提起確認專利未受侵權與無效之訴,請求法院宣告Cisco並未侵權被告OpenTV Inc.(下稱OpenTV)所擁有之6項專利,並主張Cisco該6項專利為無效。

在同案訴訟中,思科等原告亦對OpenTV、以及與OpenTV同屬Kudelski Group之數位媒體技術供應商Nagra USA, Inc.(下稱Nagra)提起專利侵權告訴,控告OpenTV提供給有線電視系統業者與收視戶電視機上盒所使用、作為條件式存取視訊裝置的產品OpenTV Middleware,以及Nagra提供給數位電視服務提供者使用之條件式內容存取系統產品MediaAccess,侵犯思科等原告所擁有、3項與數位電視服務之條件式存取系統相關的專利權利。

思科等原告在其訴狀中主張,OpenTV向思科客戶提出警告,指稱思科之相關產品或服務侵犯技術內容與系爭6項OpenTV專利相關或近似的歐洲專利;此外,思科等原告亦指出,OpenTV對另一家公司Netflix, Inc.所提起之專利侵權告訴(案號為1:12-cv-01733,基於7項專利,其中2項與OpenTV主張受思科客戶侵犯之歐洲專利權利相關),與Cisco所遭遇情況有可對照之處。思科等原告主張,基於前述事實,以及OpenTV公開宣稱其意圖透過訴訟主張其專利權利、OpenTV與思科之協商過程等,讓思科等原告有受到可透過司法救濟之實質與即刻損害之虞,所以思科等原告具有訴權基礎可以針對系爭OpenTV專利提起確認未受侵權與無效之訴。

思科等原告請求法院宣告以下6項專利不侵權或無效:

美國專利編號US 5,585,858,名稱為「互動訊號與普通視訊訊號之聯播(Simulcast of interactive signals with a conventional video signal)」,於1996年12月17日核發,思科主張該專利與其被控侵權之歐洲專利EP0723729具備實質近似之請求項;

  • 美國專利編號US 5,724,091,名稱為「經壓縮數位資料互動節目系統(Compressed digital data interactive program system)」,於1998年3月3日核發,思科主張該專利與其被控侵權之歐洲專利EP0965227具備實質近似之請求項;
  • 美國專利編號US 5,761,606,名稱為「透過嵌入視訊或音訊節目之位址進行媒體線上服務使用(Media online services access via address embedded in video or audio program)」,於1998年6月2日核發,思科主張該專利與其被控侵權之歐洲專利EP0879534具備實質近似之請求項;
  • 美國專利編號US 7,882,533,名稱為「用於互動電視之數位電視應用程式協定(Digital television application protocol for interactive television)」,於2011年2月1日核發,思科主張該專利與其被控侵權之歐洲專利EP1364511具備實質近似之請求項;
  • 美國專利編號US 7,900,233,名稱為「顯示隨選視訊之方法與系統(Process and system for displaying video programs on demand)」,於2011年3月1日核發,思科主張該專利與其被控侵權之歐洲專利EP1249128具備實質近似之請求項;
  • 美國專利編號US 7,961,743,名稱為「互動電視的服務閘道(Service gateway for interactive television)」,於2011年6月14日核發,思科主張該專利與其被控侵權之歐洲專利EP1364511具備實質近似之請求項。

還有,思科等原告就以下3項專利提起專利侵權告訴,其原始權利人均為Scientific-Atlanta, Inc.,於2005年被思科所併購之美國大型有線電視視訊轉換器生產商:

  • 美國專利編號US 6,252,964,名稱為「在條件式存取系統中進行服務授權(Authorization of services in a conditional access system)」,於2001年6月26日核發;
  • 美國專利編號US 6,744,892,名稱為「在條件式存取系統中提供地域限定服務之方法與裝置(Method and apparatus for geographically limiting service in a conditional access system)」,於2004年6月1日核發;
  • 美國專利編號US 7,505,592,名稱為「用來授權並傳送服務實例至遠端客戶裝置的裝置(Apparatus for entitling and transmitting service instances to remote client devices)」,於2009年3月17日核發。

思科等原告在其訴狀中指稱,OpenTV近年來因營收下滑,轉向透過主張專利權利來獲取利潤。(1354字;表3)
