美包裝公司加入專利訴訟戰局 Bell控GE lighting燈泡包裝方法侵權

近日如火如荼的LED照明侵權大戰加入了另類要角。繼GE Lighting, Light Transformation technologies等LED燈專利訴訟案後，美國一家位於南達科塔州(South Dakota)的包裝公司Bell Incorporated控告位於俄亥俄州(Ohio)的百年老店奇異公司之子公司GE Lighting, LLC侵犯其燈泡包裝方法專利。

原告Bell Incorporated(以下簡稱Bell)產品主力為各式各樣的包裝；其中包括可摺疊式紙箱製作(folding cartons)、客製化包裝、食品包裝、平面快遞郵件包裝(overnight envelopes)等等，其規模達全美同類產業前20強，為強調其客製化包裝之能力，Bell在其產品宣傳中特別強調其擁有數項包裝方法的專利以滿足客戶的需求，系爭技術便為其中之一。被告GE Lighting, LLC(以下簡稱GE Lighting)，奇異公司照明部門，為美國知名電子企業奇異公司的子公司之一，產線多以LED(light-emitting diode)燈或傳統照明設備為主。

本案以GE公司在南科塔州銷售、供應侵權產品為由，於2013年1月18日繫訟於南達科塔聯邦地方法院南區分庭(South Dakota District Court Southern Division Office)。Bell主張GE Lighting以製造、使用、販賣、進口、邀約販賣等方式，將使用系爭專利包裝方式的燈泡散佈於美國各地，持續的侵害該包裝專利。Bell主張，GE有許多”SKU”系列的燈泡包裝方式接侵害其美國7,357,253專利(以下稱253專利)，尤其是以”Soft White”或””Extra Soft White”為品名的產品。當中符合訴狀描述的侵權產品概略如下圖:

本案系爭253專利，名稱”燈泡的包裝以及重製方法”( Package for lightbulbs and method of making same)，目前為Bell公司所擁有，Bell於訴狀中自述其專利功能為，利用空白平板封裝、支撐、保護、複數個燈泡的包裝方法，該專利摘要及主要請求項解析如下:

Bell請求法院認定GE公司產品包裝依文義或均等理論成立侵權，應排除將來對 253專利可能的持續侵害。除了依35 U.S.C. § 284之規定判予三倍之故意侵權(willful infringement)損害賠償外，並依35U.S.C.§ 285認定本案為特殊案例(exceptional case)並准予原告律師費之補償。(892字；圖一；表二)
