Concinnitas, LLC控告Samsung與Sierra Wireless侵犯其行動通訊資料傳輸專利

2012年12月28日，一家設立於美國德州、名為Concinnitas, LLC之公司(下稱Concinnitas)，向德州東區聯邦地院提起兩起專利侵權告訴，分別控告韓國Samsung之美國分公司Samsung Electronics, USA, Inc.與其子公司Samsung Telecommunications America, LLC (統稱Samsung)，以及無線通訊公司Sierra Wireless 之美國分公司Sierra Wireless America, Inc.與法國分公司Sierra Wireless S.A. (統稱Sierra Wireless)，侵犯Concinnitas所擁有、在行動通訊環境中傳輸資料並限制其存取之技術專利權利。

在其控告Samsung的訴狀中，Concinnitas指控Samsung的智慧型手機、平板電腦等產品，如Galaxy系列產品，侵犯本案系爭專利權利；而在其控告Sierra Wireless的訴狀中，Concinnitas則主張Sierra Wireless的無線網路卡產品，如AirCard 313U，侵犯其專利權利。

本案系爭專利為美國專利編號US 7,805,542，名稱為「附屬在一行動環境中之行動裝置、其限制在相同行動環境中分離電腦對於其透過無線通訊訊號所接收資料的存取(Mobile unit attached in a mobile environment that fully restricts access to data received via wireless signal to a separate computer in the mobile environment)」，於2010年9月28日核發，發明人與原始權利人均為George W. Hindman。

在網路上並不易搜尋出Concinnitas的資訊，但根據其訴狀上所揭載之營業處所地址，Concinnitas是位於德州馬紹爾(Marshall)市East Houston Street的 104號，而該棟大樓是許多積極興訟之專利不實施實體(non-practicing entities, NPEs)的營運總部所在。與Concinnitas同樣位於Suite 170A的就有另一間專利授權公司Meadows Financial Systems LLC，這家公司曾在2012年7月與8月分別控告美國必勝客Pizza Hut, Inc.(案號為6:12-cv-00449-LED)以及德國漢莎航空Deutsche Lufthansa AG(案號為6:12-cv-00542-LED)，侵犯其一項向電話使用者提供網路服務的方法專利權利(US 8,064,434)。(534字；表2)
