貨物追蹤監控專利訴訟iLife Technologies控告OnAsset

2012年12月18日,一家設立於美國德州之專利授權公司iLife Technologies, Inc.(其為iLife Solutions, Inc.百分之百持股的子公司,下稱iLife Technologies),向德州北區聯邦地院提起專利侵權告訴,控告OnAsset Intelligence, Inc.(下稱OnAsset)公司所開發販售、裝設在貨運物品上、具備感測器用來追蹤該貨運物品之裝置,諸如Sentry 400、Sentry 400 FlightSafe等,以及其伴隨裝置所提供的相關貨運追蹤監控服務,侵犯iLife Technologies所擁有之7項與感測監控物體移動之系統有關的專利權利。

本案7項系爭發明專利之主要發明人均為iLife Technologies的執行長Michael L. Lehrman,簡要內容如下:

  • 美國專利編號US 6,307,481,名稱為「評估物體移動之系統及其操作方法(Systems for evaluating movement of a body and methods of operating the same)」,於2001年10月23日核發,其專利家族包括我國專利公告號494368 ,專利權人登記為ILIFE系統公司;
  • 美國專利編號US 6,501,386與US 6,864,796,名稱均為「裝設在通訊裝置中用來評估物體移動之系統及其操作方法(Systems within a communication device for evaluating movement of a body and methods of operating the same)」,分別於2002年12月31日與2005年3月8日核發;
  • 美國專利編號US 6,661,347,名稱為「裝設在定位裝置中用來評估物體移動之系統及其操作方法(Systems within a position locator device for evaluating movement of a body and methods of operating the same)」,於2003年12月9日核發;
  • 美國專利編號US6,703,939,名稱為「偵測物體移動之系統與方法(System and method for detecting motion of a body)」,於2004年3月9日核發;
  • 美國專利編號US 7,095,331,名稱為「偵測物體移動之系統與方法(System and method for detecting motion of a body)」,於2006年8月22日核發;
  • 美國專利編號US 7,145,461,名稱為「分析物體活動之系統與方法(System and method for analyzing activity of a body)」,於2006年12月5日核發。

iLife Technologies在本案同日、亦向相同法院另提起3起專利侵權告訴,控告不同公司所開發、用於監控警示老人跌倒的居家照護產品或服務,侵犯本案全部或部分之系爭專利。例如,其中一起是控告飛利浦旗下家庭監控設備與服務商之生命線公司(Lifeline Systems Company),所開發販售、專為年邁人士設計的跌倒警報系統Lifeline with AutoAlert,侵犯本案6項系爭專利與另一項專利US 7,479,890 (案號為3:12-cv-05157);另一起則是控告ActiveCare, Inc.與SafeGuardian, Inc.兩家公司,其在美國境內行銷販售、內建有偵測老人跌倒系統之行動電話產品GT300 Lone Worker and Senior Care Phone (由Queclink Wireless Solutions Co., Ltd.所製造),侵犯與本案相同之7項專利權利(案號為3:12-cv-05161)。

iLife Technologies公司主要產品,提供其偵測老人跌倒、阻塞型睡眠呼吸中止症候群(Obstructive sleep apnea)監控、倉儲監控、生命跡象監控等創新技術解決方案。(1186字;表3)
